Through the Eyes of a Father: How PRWORA Affects Non-Resident Fathers and Their Children

Under the Personal Responsibility and Work Opportunity ReconciliationAct (PRWORA), new laws have been enacted that focus on reducingsingle-parent families’ reliance on state assistance bycollecting child support from non-custodial parents (typicallyfathers). These laws pressure fathers to pay child support throughstricter penalties for non-payment, but do not help fathersovercome barriers (eg, unstable employment) that prevent payment.In addition, PRWORA does not help fathers gain access to theirchildren, which, according to research, promotes payment andchild welfare. A literature review indicates that children whogrow up without a father experience more psychosocial difficultyand diminished well-being compared to children who grow up ina two parent household. Thus, it is recommended that the federalgovernment make greater efforts to assist fathers in their abilityto provide emotional and developmental guidance for their childrenthrough father involvement programmes. Programmes such as mediation,parenting plans, joint custody, and parental education promotethe well-being of the children and encourage non-residentialparents to fulfill their financial commitments to their offspring,reducing the need for state aid.     

Human Rights in the Scottish Courts

This article looks at the use made of the human rights legislation in the Scottish courts since the devolution of legislative and executive power to Scotland, based on research undertaken in all the ordinary courts, but excluding tribunals. It concludes that the incorporation of the Convention via the human rights legislation has had significant effects within the Scottish court system and on policy development without amounting to a major upheaval.     

Opening Up Ownership: Community Belonging, Belongings, and the Productive Life of Property

Drawing on empirical data and property theory, this article explores the property structure of a "free school" and the work property performs there. At Summerhill, we can see a tension between two property registers. On the one hand, the founder and present members stress the importance of individual ownership; at the same time the school's property regime involves property-limitation rules, a dispersal of rights, collective forms of property, and cross-cutting, pluralized sites of institutional recognition. In exploring how this tension is manifested through property's work, the article focuses on property's contribution to a variegated social life at the school, analyzed in terms of personal, civic, and boundary relations. With belonging treated as the central component of property rather than exclusion or control, ways of understanding what constitutes property and how it works shift.
