《彩票法》立法之必要性及其属性分析

我国自上世纪80年代中期开始发行彩票,在为社会公共事业筹集了大量资金,取得巨大社会效益的同时,彩票的规模越来越大、品种越来越多,可以说彩票市场已经蓬勃发展起来了。但同时,彩票市场也存在着管理混乱、弄虚作假、使用不明等诸多问题。制度的不足是其根本原因。我国目前规范彩票业的规范性文件都是一些行政法规、部门规章。可以说,制定一部系统、全面、完善、操作性强的《彩票法》已经成为了当务之急。本文从《彩票法》立法的必要性及其法律属性方面进行了论述。

随着我国社会转型步伐的明显加快,西部农村社会稳定问题已经成为人们关注的一个焦点。农村社会稳定是指农村社会处于相对平衡发展的状态,包括各种权力关系和利益关系得到有效协调、具有稳定的家庭关系和良好的人际关系、人们的思想相对稳定、社会治安状况良好等等。     

Returns to Foreign Language Skills in a Developing Country: The Case of Turkey

This paper analyses the economic value of foreign languages in Turkey using data on some 6000 adult male wage-earners in 2007. We find positive earnings returns to proficiency in English and Russian, which increase with the level of competence. French and German skills are also positively rewarded, although their return seems mostly linked to the likelihood to hold specific occupations. In contrast, knowing Arabic does not generate an earnings premium. Focusing on English, we check for heterogeneous returns along the conditional earnings distribution. The results are qualitatively invariant when we account for misclassification errors in self-reported English skills.     

未成年人刑事司法中社会调查材料的法律性质

修改后的《刑事诉讼法》规定,对涉罪的未成年人,司法机关可以就其成长环境、教育环境、家庭监护条件等情况进行调查。由于社会调查材料在实践中适用的广泛性和混乱性,学界和实务界对此的认识比较混乱,有"品格证据说"、"鉴定意见说"、"量刑事实说"、"法庭教育材料说"等观点。本文意在剖析社会调查材料的本质,挖掘其特有的诉讼价值,以期更好维护未成年人的合法权益。     

Methadone determination in puparia and its effect on the development of Lucilia sericata (Diptera, Calliphoridae)

This paper describes a sensitive UPLC-MS/MS method for quantification of methadone and 2-ethylidene-1,5-dimethyl-3,3-diphenylpyrrolidine (EDDP) in single empty puparial case of Lucilia sericata. Larvae were reared on substrates spiked with different concentrations of methadone (0-4 μg/g). Methadone was quantified in puparia reared on high concentrated substrates (0.8-4 μg/g). The major metabolite of methadone (EDDP) was not detected, confirming rapid elimination of metabolites by the larvae before pupation. The effects of methadone on the development of L. sericata were also investigated. No effect on sex ratio was detected. A significant difference was calculated for emerged adults but no trends could be observed. Concerning the developmental curve, a significant difference was observed between control and high methadone concentrations using the Kolmogorov-Smirnov test.     

The mediational role of values in linking personality traits to civic engagement in Italian youth

In recent decades, given new forms of political participation, the involvement of young people in the civic domain begins to be a focus of many studies. The present study examined the role of personality traits and personal values in the prediction of civic engagement (CE) in Italian youth ranging in age from 19 to 29 years old involved in an ongoing longitudinal study. The multidimensionality of a scale tapping CE has been demonstrated with the examination of confirmatory factor analysis. Structural equation modeling corroborated a mediational model in which benevolence fully mediated the relationship of the traits of agreeableness and openness with civic associationism, whereas power fully mediated the relationship of the traits of agreeableness and openness with political associationism. In this mediational model men reported higher levels of power than women, whereas women reported higher levels of agreeableness and openness traits. Since basic personal traits have been identified as the root of any behavioral tendency and values have been recognized as the more flexible and changeable variables, future interventions aimed to foster CE in youth could be designed considering the strength relationship between the examined dimensions in the present study.     

职务犯罪心理特征分析

犯罪心理是犯罪行为发生的内在根据。职务犯随着职位升迁,比较对象变化,特别是面对他人的阿谀奉承和糖衣炮弹,他们的欲望持续膨胀,自我发生扭曲,认知出现错误,心理产生失衡。一旦官员的自我调控弱化,而外在制度对权力控制又不力,官员就容易在各种侥幸心理支配下,实施以权谋私的职务犯罪。     

10个STR基因座荧光复合扩增体系的研制

目的建立10个STR基因座荧光标记复合扩增体系,并评价其法医学应用价值。方法在北京、山西、广东汉族,辽宁满族、西藏藏族群体中调查STR基因座遗传多态性,筛选出9个具有高度多态性和法医应用价值的STR基因座及性别基因座。构建四色荧光素标记复合扩增体系,制备等位基因分型标准物,编制分析软件,并对体系的种属特异性、灵敏度、稳定性、混合样本等检测能力进行考察。结果建立的复合扩增体系遗传稳定好,累积非父排除率可达0.999 96,累积个体识别率可达0.999 999 999 999 3;与CODIS系统均不存在连锁遗传;各基因座间布局合理、无杂峰、扩增结果清晰易辨,并可实现检测分析自动化。体系种属特异性较好,灵敏度为0.1ng,稳定性好,混合样本检出范围在2∶8～8∶2之间。实际案例检材检测结果好。结论本文建立的复合扩增体系在法医学实践中有较好的应用价值。
