This article examines the different legal articulations between indigenous typologies and topologies, that is, the relationship between someone classified as an indigenous subject, a grantee of minority rights, and the spatial arrangements such as reservations or ancestral territories considered necessary for indigenous “cultural survival.” I analyze how the jurisprudence of the Colombian Constitutional Court manifests and rests on the diverse combinations of these two factors. The typology/topology binary characterizes the manner in which these legal discourses portray indigeneity and culture. This binary also offers insight into a broad range of issues, including the access that indigenous peoples have to minority rights, the use of customary law, and the spatial delimitations that frame indigenous legal jurisdictions. Some of the complexities that arise from this binary are: the conceptualization of indigenous places as habitats, the idea of culture as a list of traits, and the concept of “degrees” of indigeneity that determine these peoples' access to minority rights. 相似文献

Purpose
Studies of criminal decision making commonly rely on college students’ self-reported intentions to commit a hypothetical offense. The current study evaluates the predictive validity of these intentions to offend.Methods
Undergraduate students (n = 726) read a fictitious but seemingly realistic newspaper article describing an illegal opportunity for acquiring digital music files, and then reported their intentions to act upon the opportunity. Afterward, participants’ real world attempts to follow-through on the opportunity were monitored covertly.Results
Findings reveal that participants who reported weak intentions to offend typically refrained from the act, resulting in a low false negative rate. However, those who reported strong intentions to offend also typically refrained from the act, thereby resulting in a high false positive rate.Conclusions
These findings suggest that while participants’ predictions of criminal abstention are generally accurate, their predictions of criminal involvement are more problematic. Such faulty intentions have important implications for research on criminal decision making. 相似文献164.

Based on 39 semistructured interviews with senior emergency management practitioners spanning organizational boundaries, this paper proposes a typology of boundary spanning activities for emergency management. This paper reviews briefly the emergence of holistic governance at the strategic and very local levels in rural England before reporting a programme of action research designed to address the need to develop an effective ‘bridge’ between planning activity at those two levels. Attention is focused particularly upon the recent wave of parish and market town plans on the one hand and local strategic partnerships and community strategies on the other. Taking cognisance of relevant contextual literature relating to representative and participative democracy and to top-down and bottom-up planning, it draws conclusions about the challenge of developing a synergistic relationship between strategic and very local planning and about the prospects for reconciling some of the tensions pointed up in those theoretical debates. 相似文献

In this article we explore the response of European trade unions to the 1990s steel crisis. Trade unions have faced wide ranging challenges including: the globalisation of the industry; steel companies becoming increasingly international; privatisation; the eastern European steel market; the liberalisation of world trade; the new emerging priorities of the EU and internal company reorganisation. Our key argument is that their response has been highly traditional and unsuited to the new challenges. Abstract The Black-Scholes-Merton formula has been put to widespread use by options traders because it provides a means of calculating the theoretically ‘correct’ price of stock options. Traders can therefore see whether the market price of stock options undervalues or overvalues them compared with their hypothetical Black-Scholes-Merton price, before choosing to buy or sell options accordingly. As a consequence of this close relationship between options pricing theory and options pricing practice, a strong performativity loop was activated, whereby market prices quickly converged on the hypothetical Black-Scholes-Merton prices following the dissemination of the formula. The theory has therefore had significant real-world effects, but how should we characterize the initial instinct to derive the theory from a philosophy of science perspective? The two books under review suggest that a Kuhnian reading of the advancement of scientific knowledge might well be the most appropriate. But, on closer inspection, it becomes clear that the publication of the Black-Scholes-Merton formula should not be seen as a Kuhnian moment with paradigm-shaping attributes. It is shown that, at most, the formula acts as an important exemplar which, via its use in the training of options pricing theorists and options pricing practitioners, reinforces the entrenchment of finance theory within the orthodox economics worldview. 相似文献

ABSTRACTThis article presents the development and validation of a psychometric scale for assessing public sector inter-agency trust. The instrument is grounded in contemporary trust theory and methodologically adapted from a measure developed for private sector alliances. Tested using four discrete studies of governance networks, each addressing transboundary environmental issues such as climate change and fisheries, the scale exhibits reasonably valid psychometric properties while also enabling visualized analysis of networked trust distributions. Based on this work, we outline further research needs with a view to stimulating greater trust research in governance networks and facilitating more collaborative and innovative policy outcomes in the public sector. 相似文献

National agricultural policies intended to stabilize farm price and income may have different impacts on different agricultural sector of a state or a region. A policy which influences a region's agriculture also may affect the general economy of that region, depending on the degree to which agriculture is linked to the general economy. This study evaluates the economywide impact of the Flexible Planting Program (FPP) -- a recent policy designed to encourage farmers to respond more to market than to the government incentives. The study employs an integrated modeling framework which links the national and state farm sectors to the region's non-farm sectors. Because of reductions in real U.S. market prices and, in turn, Tennessee market prices of some farm commodities under FPP, production of most agricultural outputs are expected to decline in Tennessee by 1995. Study results indicate that as a result of price reductions, the agricultural sector will lose about 15 percent of output, income, and employment. These losses cause significant negative impacts on the business-related service sector. The service sector suffers a loss of 31 million dollars in total output and 523 jobs. The total income lost by the service sector (18 million dollars) will be much higher than agriculture sector (11.99 million dollars). Thus, though the FPP may deliver its intended good at the national level, the policy has the potential to cause undesirable impacts on certain regions. 相似文献
