Is there only One Correct Legal Answer to a Question of Fact? Three Talmudic Answers to a Jurisprudential Dilemma

This article focuses on questions of pure fact‐of‐the‐matter and asks whether two omniscient judges (or jurists or scholars) may disagree over the legal answer to a straightforward question of a matter of fact. There are approaches to legal theory among some western and Jewish philosophers of law whereby at least superficially it is possible that two or more contradictory legal statements regarding a given reality can be equally correct. The article provides a critical analysis of three different models derived from the Jewish legal literature, and reviews the contributions of Jewish sources to the understanding of the phenomenon of disagreements concerning matters of fact.     

Intimate Partner Violence as a Risk Factor for Mental Disorders: A Meta-Analysis

This article reviews literature on the prevalence of mental health problems among women with a history of intimate partner violence. The weighted mean prevalence of mental health problems among battered women was 47.6% in 18 studies of depression, 17.9% in 13 studies of suicidality, 63.8% in 11 studies of posttraumatic stress disorder (PTSD), 18.5% in 10 studies of alcohol abuse, and 8.9% in four studies of drug abuse. These were typically inconsistent across studies. Weighted mean odds ratios representing associations of these problems with violence ranged from 3.55 to 5.62, and were typically consistent across studies. Variability was accounted for by differences in sampling frames. Dose-response relationships of violence to depression and PTSD were observed. Although research has not addressed many criteria for causal inferences, the existing research is consistent with the hypothesis that intimate partner violence increases risk for mental health problems. The appropriate way to conceptualize these problems deserves careful attention.     

You All Made Dank Memes: Using Internet Memes to Promote Critical Thinking

In the time following the 2016 presidential election, much has been written about the spread of false information on social media websites. Given the potential influence false information has had on American politics, it is more important than ever for people to critically evaluate the content they view and share on social media. This article describes an activity that encourages students to develop evidence based arguments and think critically about content shared on social media. In the activity, students are asked to generate an internet meme related to U.S. politics and write a short essay defending the position they have taken in the meme. This article explains how the activity can promote critical thinking and includes suggestions for future implementation.

This paper follows the Salt-Wind and subterraneous freshwater flows in Hawaiian poet Brandy Nālani McDougall's collection of poetry The Salt-Wind/Ka Makani Pa‘akai. McDougall illustrates that in order to begin again in the aftermath of American imperialism and environmental destruction, one must return to the salt-water and sub-surface waterings, and the ancestral connections and voices therein who beckon her (and others) home. In this way, her work is situated within contemporary movements within the Pacific, presently coming together in deimperializing efforts to restructure a future for the Pacific that is ‘beyond empires’ (Fujikane, 2012: 191). Selecting two poems in particular from McDougall's collection—‘Hāloanaka’ and ‘On a Routing Slip from the U.S. Postal Service, Pukalani Branch’—I illustrate how they chart the ancestral, cosmological, and historical flows of kinship between Kānaka Maoli and their near and distant earthly and spiritual relations. In particular, the water that passes through the taro plant infuses all manner of kinship, economic, and social relations in Hawai‘i, connecting Kānaka Maoli to their ancestor Hāloa, and to land, sea, and each other, as well as—through the formative oceanic movements of Moana Nui—to other Pacific islanders. A thirst for water—sacred, imaginative, mobile, past, present—underwritten by an assertion of Hawaiian sovereignty, language, and tradition flows just beneath the surface of McDougall's words.

Sexual Abuse as the Core Transgression of Childhood Innocence: Unintended Consequences for Care Leavers

ABSTRACT

The decision of the Gillard government to establish a royal commission in 2012 was acclaimed by care leavers. However, they were soon disillusioned: it was not the royal commission for which they had long struggled. Its terms of reference were too broad, encompassing a range of institutions never before the subject of official inquiries, yet also too narrowly focused on sexual abuse. Care leavers who suffered other forms of abuse were excluded. This paper argues that, while care leaver advocacy contributed to the decision to establish a royal commission, the agenda was a product of other pressures fuelled by state-based inquiries about cover-ups of sexual abuse of children, particularly by clergy. Sexual abuse could no longer be regarded as a sin to be handled in-house by institutions but a crime for which the state carried superordinate responsibility. The government had to intervene to address society’s “ultimate collective shame”. The Royal Commission into Institutional Responses to Child Sexual Abuse has made a massive contribution to our understanding of child sexual abuse and to reforms in child protection policy and practice. But its mandate created unintended consequences, and questions remain about the unmet needs of care leavers who suffered other forms of abuse.     

Emerging Parenting Coordination Practices Around the Globe: What We Have Learned

Parenting coordination is emerging in numerous countries around the globe as a response to the need to protect children in families whose parents experience high conflict following their separation or divorce. This article describes the different trends in the implementation of parenting coordination programs in Canada, Spain, and Italy and the socio‐legal contexts in which they have evolved. An analysis will also be presented of the unique challenges faced by these countries and the ensuing debates on issues related to the referral process, legal procedures, decision‐making authority, judicial immunity, confidentiality, and professional requirements and training for the appointment of parenting coordinators. The authors will present what has been learned from their respective experiences and make recommendations to promote continued development.
