The war over the Israeli settlements

In the last eighteen months, missile defence has emerged as a controversial issue between the United States and its European allies. The administration's plans have provoked a major debate in Europe and the United States. Since the spring of 2007, however, the Bush administration has begun to develop a much more effective public outreach campaign designed to address public concerns. It has also sought to strengthen the link between its bilateral efforts at missile defence and those of NATO and made a number of important proposals designed to reduce Russian concerns.

Participation in a residential mobility program from the client's perspective: Findings from Gautreaux Two

Abstract

In 2002, the Gautreaux Two housing mobility program provided low‐income families living in Chicago public housing with the opportunity to move to more affluent, less racially isolated communities. This article presents findings on their complex search and moving process. Only about one‐third of enrolled families actually moved through the program ("leased‐up"). In‐depth interviews with a randomly chosen sample of 71 families and an additional 20 “likely mover” families showed that movers fell into four groups distinguished by personal characteristics that made it easier for them to move or by residence on Chicago's North Side.

Nonmovers faced a variety of obstacles, both external (a tight rental market, discrimination, and bureaucratic delays) and internal (limited experience and program comprehension, large household size, and health problems). Also, some nonmovers were too busy with work or school to engage in what proved to be an onerous process of identifying a suitable unit and moving.     

Child characteristics and successful use of housing vouchers: Estimates from the moving to opportunity demonstration

Abstract

Voucher‐based programs have become the most common form of housing assistance for low‐income families in the United States, yet only a slim majority of households that are offered vouchers actually move with them. This article uses data from 2,938 households in the Moving to Opportunity demonstration program to examine whether child characteristics influence the probability that a household will successfully use a housing voucher to lease‐up.

Our results suggest that while many child characteristics have little bearing on the use of housing vouchers, child health, behavioral, and educational problems, particularly the presence of multiple problems in a household, do have an influence. Households with two or more child problems are 7 percentage points less likely to move than those who have none of these problems or only one. Results suggest that such families may need additional support to benefit from housing vouchers or alternative types of affordable housing units.     

The political role of the Japanese media

This article examines the political role of the mass media in contemporary Japan. Journalists, especially newspaper reporters, have long enjoyed privileged access to politicians through a system of kisha (reporters') clubs, a system which allows for a cosy rapport between reporters and their sources, but often works against the public interest. In recent years, however, some television journalists have adopted a more rigorous approach to political stories. Critical programming by television stations such as TV Asahi may have contributed to the end of 38 years of Liberal Democrat Party rule in 1993. Nevertheless, there is insufficient evidence to argue that the Japanese media is now acting as an effective political watchdog. Like the mass media in many other Asian countries, the Japanese media continues to enjoy an ambiguous relationship with holders of political power.     

The Paradox of American Critical Legalism

Duncan Kennedy's essay is a reprint from his recently published book. We hope to draw attention to Kennedy's work among students of European integration since we believe his analysis to be relevant both to the specific debate on the impact of European integration upon private law and to comparative legal study in general. European legal scholarship has only recently begun to examine the problems of private legal integration. The late appearance of private law in the integration arena is due to a primarily instrumental understanding and strategic use of law in the European market-building project: only once legal ‘barriers to trade’ were eliminated and national regulatory law replaced by Europeanised norms, did the degree to which the core institutions of ’private‘ law had been (indirectly) affected by the integrationist logic become apparent. Comparative legal research, however, has benefited from this awakening of interest. European Commission projects have widened the scope of and intensified comparative studies in Europe. Equally, experience gained from the ‘Integration Through (Public) Law’ project has led to a new private legal debate on the impact of national traditions, the concept of legal cultures and the social functions of private law. Accordingly, whilst Duncan Kennedy's deliberations on the history of American legal thought and the differences between American and European legal cultures are generally to be commended for their sensitive treatment of the specificities of the civil law system and the common law heritage, they are equally of particular topical concern since in addition to highlighting America's ‘utter faith and utter distrust in law,’ they also investigate the fundamentally different approaches adopted towards ‘the project law’ within each of the member states of the EU. If European private lawyers are to come to terms with the problems of integration and convergence, they must first tackle these deep-seated divergences between their own national legal cultures.

Jacob LJ untangles the web of unopposed patent appeals and decides the patentee should pick up the bill
