台湾地区民法错误论评析及其借鉴——一个基于法律史和学术史的考察

电商标价错误案引发两岸民法学界对传统意思表示错误制度之共同关注.台湾地区民法错误论源自罗马法一德国法传统,并受到日本法的一定影响.在错误类型上,台湾地区民法沿袭德国“内容错误”与“表示行为错误”之界分,性质错误“视为”内容错误.在错误撤销上,创造性地增加了表意人过失要件之限制,相对人之可归责性亦成为影响表意人行使撤销权之考量要素.两岸民法错误论存在着内生机理上的共通,使得大陆民法错误论寻求台湾地区经验之借鉴成为可能.     

An Empty Shell? Rethinking the Usury Laws in Medieval Europe

Abstract

Many historians have argued that the usury laws were a dead letter and that usurious practices were widespread during the Middle Ages. This review of canonical rule formation in Europe shows that many contracts were outside the prohibition and that the laws were highly effective. The popularity of financial instruments depended on obtaining the Church's approval, and ecclesiastical tribunals pursued usurers relentlessly. Although it is not possible to measure with any precision the incidence of usury or the effectiveness of the prohibition, arguments of a high incidence of usury do not stand up in the light of evidence from the contemporary legal context.

Portable high‐resolution automated 3D imaging for footwear and tire impression capture

The forensic science community raised the need for improved evidence recognition, collection, and visualization analytical instrumentation for field and laboratory use. While the 3D optical techniques for imaging static objects have been extensively studied, there is still a major gap between current knowledge and collecting high‐quality footwear and tire impression evidence. Among optical means for 3D imaging, digital fringe projection (DFP) techniques reconstruct 3D shape from phase information, achieving camera‐pixel spatial resolution. This paper presents a high‐resolution 3D imaging technology using DFP techniques dedicated to footwear and tire impression capture. We developed fully automated software algorithms and a graphical user interface (GUI) that allow anyone without training to operate for high‐quality 3D data capture. We performed accuracy evaluations and comparisons comparing with the commercial high‐end 3D scanner and carried out qualitative tests for various impressions comparing with the current practices. Overall, our technology achieves similar levels of accuracy and resolution with a high‐end commercially available 3D scanner, while having the merits of being (1) more affordable; (2) much easier to operate; and (3) more robust. Compared with the current practice of casting, our technology demonstrates its superiority because it (1) is non‐destructive; (2) collects more evidence detail than casts, especially when an impression is fragile; (3) requires less time and money to collect each piece of evidence; and (4) results in a digital file that can easily be shared with other examiners.

党的十九大报告将“全面净化党内政治生态”作为全面从严治党道路上不可或缺的重要举措。改善农村党支部“小生态”是净化全党“大生态”的重要组成部分。只有充分发挥村党支部政治功能,加强基层党组织建设,才能构建日渐清朗的基层政治生态,全面提高基层党组织的凝聚力和战斗力,保证党的肌体健康强壮,否则,基层政治生态弊病丛生,党的肌体就会逐渐被侵蚀。研究农村基层党组织政治生态问题,必须放在深入落实全面从严治党的大背景下,以问题为导向,在新视角、新框架下审视农村基层党组织,实施农村基层党组织精细化管理,优化农村政治生态。

履行迟延的合同解除规则释论

针对主给付义务的履行迟延,符合我国《民法典》第563条第1款第3项、第4项的构成要件即可解除合同。符合我国《民法典》第563条第1款第3项之情形,直接落入“主要债务”的文义射程。合同解除法上的广义附随义务囊括了传统“债法上之义务群”中的狭义的附随义务与从给付义务,只有迟延履行广义附随义务不符合合同目的,方落入“主要债务”的射程,此时需将“主要债务”进行目的性扩张解释。在履行迟延中,应将我国《民法典》第563条第1款第4项作目的性限缩解释,并可采用类推适用违约损害赔偿的可预见性规则予以适用。就合同目的不能实现之判断,以公式来表明,即为“重大违约(需结合个案判断)+并非债务人订约时不可预见或不可认识(当事人主观标准+理性人标准)=合同目的不能实现”。可预见性的判断时点为合同订立时。不能实现合同目的的举证责任原则上由主张根本违约之一方当事人负担,但在如合同已明定给付日期等无争议之重要事项之场合,当事人无需负担举证责任。履行迟延中的合同解除权之发生不以债务人的可归责性为必要。在解释上,应当认为我国《民法典》第563条第1款第3项适用于非定期行为,我国《民法典》第563条第1款第4项适用于定期行为。关于相对的定期行为之成立,除有“履行期日严守”要件之外,还须结合合同目的予以判断。
