This paper assumes that lawyer independence is a component of the rule of law and that, as such, it deserves as much protection as does independence of judges. The author posits that lawyer independence can only be protected if lawyers govern lawyers. England and Queensland are cited as examples of jurisdictions that have undermined lawyer independence by adopting lawyer regulatory measures aimed at consumer protection. Canada is cited as a jurisdiction that seeks to preserve lawyer independence by recognising that lawyers who have committed to act in the public interest can satisfactorily regulate other lawyers. The author suggests that lawyer independence is a public trust, that all lawyers are the trustees and that they must resist the implementation of regulatory arrangements that compromise lawyer independence. He proposes a method for dealing with corrupt or complacent lawyer regulators.  相似文献

The present study investigated the extent to which young adults' reports of—and desires for—maternal and paternal involvement differed between intact and divorced families. An ethnically diverse sample of 1,376 young adults completed measures of reported and desired mothering and fathering across 20 parenting domains. Results indicated that both reports of and desires for father involvement differed sharply by family form (intact versus divorced), whereas few family form differences emerged for reported or desired mother involvement. These findings are discussed in terms of implications for custody and access decisions within the family court system.  相似文献

ABSTRACT

The education Sustainable Development Goal includes a commitment to ensuring that all children – regardless of their gender and circumstances within which they are born – should complete free, equitable and quality primary and secondary education. The Commonwealth Heads of Government Meeting in April 2018 re-affirmed the importance of 12 years of quality education for all, particularly marginalised groups including disadvantaged girls. To inform these commitments, this paper aims to situate the current evidence on girls’ education across the 53 countries in the Commonwealth, with a particular focus on low- and lower-middle income countries where the challenges are the greatest. It identifies the current status of access to school and learning, and highlights trends in domestic and aid financing to support the targets. It then presents evidence on interventions aimed at tackling barriers to girls’ access and learning to achieve the commitments. The paper argues a need not only to focus on gender parity in education – i.e. an equal proportion of girls and boys in school and learning – but also to pay greater attention to the more ambitious target of gender equality, which requires an end to discrimination if a truly level playing field is to be achieved.  相似文献

ABSTRACT

In sub-Saharan Africa many individuals rely on non-state health providers, and engagement between state and non-state providers is increasingly common. Little analytic work has been done on the varied models of engagement, resulting in a lack of clarity about the promises and challenges of public–private engagement (PPE) for health. Despite their prevalence, PPEs often fail. Faith-based health providers (FBHPs) form a significant proportion of the non-state health sector in sub-Saharan Africa, and the number of partnerships with FBHPs is increasing. Building on a prior systematic review project that developed a typology of organisational models for PPE for health, this article reports on a secondary analysis, highlighting PPE initiatives with FBHPs.  相似文献

The importance of science in development has been increasingly recognised in development discourses and policy since 2000. Engineering is less visible though engineering and engineers are important for the building and maintenance of transport, water, energy, industrial, informatics, urban and health systems. This article aims to investigate why engineering has not received more emphasis, including why development engineering has not been institutionalised like tropical medicine. It explores the nature of engineering in development, highlights recent efforts to headline engineering for development and, using analyses of what engineers know and do inside international development, suggests that its profile and effectiveness is emerging.  相似文献

Recognition is what makes science move forward. Yet, late recognition has been an existing phenomenon in the scientific community for centuries. Does this phenomenon of “Sleeping Beauties”, as these works are sometimes called in academic literature, exist in Political Science? The bibliometric analysis we applied showed a positive answer. Our paper is the first case study of “Sleeping Beauty” that is not an article but a book. The book by A. F. Bentley, The Process of Government, serves as an example of “Sleeping Beauty” in the Political Science domain. What put this work to “sleep”? And why, at some point, it has been suddenly “awakened” by a large number of citations? Although it has been discussed previously as a neglected classic, no bibliometric analysis has been applied to examine it and assumptions for its neglect and rediscovery presented by previous authors differ from our bibliometric findings.  相似文献

Of all the terms in modern social science, none is more reviled by academics today than “civilization.” Post-colonial theorists such as Aimé Césaire and Edward Said have influenced generations of scholars who see the term as little more than a veil for scientific racism and colonial aggression. The sociologists Norbert Elias and Pierre Bourdieu have also portrayed European conceptions of civilization as justifications for social hierarchy and exclusion. This article highlights the convergent denunciation of “civilization” by these theorists. The article provides a fresh perspective on the history of the word “civilization” by highlighting the role of the term in generating an atmosphere of self-critical reflection. The word “civilization” post-dates, and bears a strong trace of, Rousseau’s indictment of modern society in The Discourse on Inequality. The first author to use the word “civilization,” the Marquis de Mirabeau, spoke in a Rouseauian fashion of “false civilization” and “the barbarity of our civilizations.” In nineteenth- and twentieth-century usages, “civilization” was a central term in the framing of questions about the contradictory nature of progress. The term even figures prominently in debates about the basis of colonial authority—debates sponsored by some colonial administrators themselves. Some of the top colonial administrators in the early twentieth were pioneers in advancing cultural anthropology. These administrators forged the viewpoint that natives had valuable “civilizations” of their own. The radical theorists discussed in this article have portrayed “civilization” as a sign of colonial arrogance inherited from a hyper-rational and chauvinistic Enlightenment. In contrast, this article traces how a keyterm was born in the liberal atmosphere of the Enlightenment and generated an expanding space of self-doubt afterward. When we appreciate that a large slice of modern Western civilization is a critical inquiry about the meaning of itself, and when we recognize that the language of civilization helped create a public sphere of doubt even within the colonial enterprise, we can conclude that the radical theorists discussed in this essay are less than reliable guides to the contours of European cultural history.  相似文献
