Institutions and social movements: the case of comparable worth

Employing evidence from the history of the comparable worth movement, I argue that (1) the State-citizen shaping process is one in which States shape citizens and movements and citizens and movements shape States; (2) States are not always successful in shaping movements because movemnts require a certain level of both stakes and consciousness on the part of potential members; (3) States are more effective at influencing whether a movement will win than they are at actually producing social movements; and (4) the costs and benefits associated with the various institutional channels impact heavily upon a movement, particularly upon its organization and its alliances. These theoretical propositions provide clues as to why the comparable worth movement has been able to persist at the state and local level despite Federal opposition.

Men and Women of Elite Law Firms: Reevaluating Kanter's Legacy

This paper tests the effects of minority partner representation on minority associate representation in a sample of 97 law firms from 1980 to 1990. We perform separate analyses for women, African Americans, Hispanics, and Asian Americans, and we consider both within-group and cross-group effects. We find that minority partner representation has a positive effect on minority associate representation, which is statistically significant in the case of women and Asian Americans. Our findings are consistent with lawyers'own accounts, which emphasize the impact of partner composition on the distribution of rewards within law firms. We also show how our findings clarify previous studies about the effects of minority representation on the distribution of organizational rewards, focusing particularly on Kanter's work and subsequent related research.     

Executive Environmental Law

The Draft Environment (Principles and Governance) Bill published by DEFRA in late 2018 is part of a process of reimagining environmental law in light of Brexit. The Draft Bill creates frameworks for policy statements on environmental principles and environmental implementation plans, as well as creating a new enforcement body – the Office for Environmental Protection. This Draft Bill is, at the very least, an ineffectual response to the challenges of environmental law post-Brexit. More alarmingly, it raises the possibility of a legal future in which the executive dominates how the norms, ambitions, and accountabilities of environmental law are defined. These are matters of concern for environmental and public lawyers alike.     

Post-disaster reconstruction: lessons from Nagapattinam district,India

As disaster losses continue to rise around the world, it has become increasingly important to understand the long-term outcomes of post-disaster recovery programmes. Often, disaster recovery projects have an abbreviated planning period, involve multiple NGOs, and lack long-term plans for evaluation. This article describes outcomes of the shelter reconstruction programme following the 2004 Indian Ocean tsunami in Nagapattinam, India. Quantitative and qualitative data were collected to assess the effect of the programme on housing, community infrastructure, and livelihoods. The study provides useful lessons for future reconstruction programmes and demonstrates the importance of evaluating post-disaster recovery programmes after projects end.
