Identifying Miscarriages of Justice: Why Innocence in the UK is Not the Answer

This article examines two contrasting proposals for the reform of criminal appeals: the government's recent proposal that the guilty should no longer have their convictions quashed on 'technicalities'; and calls by campaigners for the Court of Appeal to consider innocence rather than the 'safety of the conviction,' together with their associated attempts to establish Innocence Projects in the UK. Despite the rhetorical power of 'innocence' as a campaigning tool, it is contended that to import such a standard into the legal system would be retrogressive and counter-productive, both as a safeguard against wrongful convictions and in protecting the integrity of the system. In order to be meaningful, due process protections must apply to all. The government's proposals attack this principle directly; innocence campaigners risk unwittingly assisting their endeavours.     

International Signaling and Economic Sanctions

Do economic sanctions serve international signaling purposes? A fully structural statistical model that employs a signaling game as a statistical model is used to investigate the existence of signaling effects of sanctions. Estimation results suggest that sanctions fail to work as a costly signal. The cheapness of sanctions prevents a target state from being able to distinguish a resolute sender state from a sender who is bluffing. When sanctions are imposed, a target rarely updates its initial evaluation of the sender state’s resolve, much less than when a military challenge is observed.     

Institutional memory,institutional capacity: narratives of failed biomedical encounters in East Africa

Abstract

This paper focuses on a series of failed medical encounters that took place in East Africa in the 1950s and after, and explores how the organizations involved ? the Kenyan Division of Insect Borne Diseases, the East African Medical Survey, and the Tanzanian National Institute of Medical Research ? chose to document and remember these events. The examples focus on medical encounters characterized by disagreements and miscommunications that stymied productive work. In each case, failures were remembered in very stylized and restructured ways that stressed the validity of the science and the valor of the scientists while drawing on tropes of African communities as irrational and superstitious. Capacity is built and maintained by having a functional institutional memory, which includes recounting failure and an ability to integrate knowledge from failure, leading to new approaches. It is found that remembering failures in such stylized forms systematically diminished the functionality of their institutional memory.     

Conflict Appraisals in a Multiethnic Sample of Children Exposed to Intimate Partner Violence

Childhood exposure to intimate partner violence (IPV) is a serious public health issue, affecting millions of children each year. IPV-exposed children are at risk for developing behavioral and emotional problems. The Cognitive-Contextual Framework posits that children’s post-conflict appraisals of threat and self-blame mediate these negative outcomes. However, conflict appraisals have primarily been studied in White, school-aged children. This study includes a large, multi-ethnic sample of children ages 5–12 (N = 158) who were interviewed regarding their experiences with family violence. The sample included White, Black, Latino/a, and biracial children. Self-blame was equivalent across groups. However, groups differed in threat appraisals, and Latino/a mothers and children reported discrepancies in the level of IPV-exposure. Directions for research and clinical implications are discussed.
