In this article we examine the rate at which patent applications are granted as a function of the inventor's race and gender. Empirical analysis of more than 3.9 million U.S. applications finds minority and women applicants are significantly less likely to secure a patent relative to the balance of inventors. Further analysis indicates that a portion of this bias is introduced during prosecution at the Patent Office, independent of the quality of the application. Mechanisms underlying these disparities are explored. The article concludes with a discussion of our results and their interaction with patent law, innovation policy, and employment trends. 相似文献

Much literature in public administration debates the role of the public servant in the policy-making process. Some literature acknowledges an integral role of the public servant in the process. However, this role often remains obscure, due to being couched in abstract terms. The hierarchical structuring of responsibilities and power within bureaucracies imparts the capacity for differential influence. This paper provides a case study of the role of the Public Service Board (power over staffing) and the Australian federal Treasury (power over the purse) in the shaping of the bureaucratic structure. The case study centres on the industry policy bureaucracy in the volatile decade after World War II. In shaping the bureaucratic capacity, the Board and the Treasury exerted a discretionary influence on the policy process itself. 相似文献

Why have some national governments acted more aggressively to address the HIV/ AIDS pandemic than others? More specifically, what explains, widely varied responses across Brazil and South Africa—two countries where one might have expected more similarity than difference? We argue thatboundary institutions—those sets of rules and practices that give social and political meaning to group identities—help explain this puzzle. Institutions interact with other pressures to structure the dissemination of information, the construction of risk, and priorities within society. Where institutions divide groups deeply, elites and ordinary citizens are less likely to feel volnerable, and more likely to blame other groups, making aggresive government action far less likely. 相似文献

In attempting to discredit an eyewitness, it is a common strategy for an attorney to highlight inconsistencies in the eyewitness's recall testimony during cross-examination and encourage the jurors to infer, based on those inconsistencies, that the eyewitness's memory is faulty. An experiment was conducted to examine the effectiveness of this cross-examination strategy. Subjects viewed a simulated cross-examination and rendered judgmenets about the eyewitness and defendant. The type of inconsistent testimony was manipulated between subjects. Subjects exposed to inconsistent recall testimony about either central or peripheral details perceived the eyewitness as less credible (as evidenced by ratings on multiple dimensions) and the defendant as less culpable. Inconsistency on central details led to fewer convictions. Results point to the effectiveness of this cross-examination strategh. 相似文献

The problem of protecting consumer interests in the regulatory process is viewed from the free enterprise, progressive, and pluralist paradigms. Berman considers the characteristics of each paradigm, the ways reformers have sought to implement each, and how they interact and shape the nature of the regulatory system. The greatest conflict lies between the free enterprise and progressive paradigms on the need for regulation. Electronic monitoring (EM) of offenders has been in use for just over two decades and motives for using it remain diverse. Some agencies that use EM attempt to deliver humane and affordable sanctions while others seek to relieve jail crowding or to avoid the construction of new jails. Nonetheless, all EM programs aim to suppress the criminal behavior of offenders being monitored and its advocates have always hoped EM could be instrumental in reducing long-term recidivism. This review investigates the history of EM and the extent to which EM empirically affects criminal behavior in moderate to high-risk populations. All available recidivism studies that included at least one comparison group between the first impact study in 1986 and 2002 were considered for the review. Although variants such as GPS tracking and continuous testing for alcohol in perspiration have recently emerged, no studies of these technologies were found that met the review’s inclusion criteria. Studies are examined and combined for meta-analysis where appropriate. Given its continued and widespread use and the dearth of reliable information about its effects, the authors conclude that applications of EM as a tool for reducing crime are not supported by existing data. Special districts are increasingly important in the landscape of public organizations and now constitute about 40 percent of all U.S. jurisdictions. Yet little is known about the public value commitments of managers in special districts. This systematic study of senior managers in large special districts finds that support for public values is strong and similar to that of senior managers in cities. This study explores the effect of concomitant commitments to “businesslike” values on public values and the impact of concomitant commitments on perceived organizational outcomes. Though a positive relationship exists between commitments to public and businesslike values among senior managers, the authors find evidence that both too much and too little commitment to businesslike values has a negative impact on perceived organizational outcomes, which are furthered by strong commitment to public values.
