Hart's will theory of rights has been subjected to at least three significant criticisms. First, it is thought unable to account for the full range of legal rights. Second, it is incoherent, for it values freedom while permitting an agent the option of alienating his or her capacity for choice. Third, any attempt to remedy the first two problems renders the theory reducible to the rival benefit theory. My aim is to address these objections. I argue that will theory has been made vulnerable due to misinterpretation. The theory has been characterized as placing great stress on liberty rights (or claim-protected liberties), whereas it is powers that are central, and hence not choice but control. My argument does, however, depend upon appealing to an extra-legal notion — the hypothetical contract — but I argue that this is consistent with the main aim of a theory of rights.  相似文献

This article explores the relations between voluntary organisations and the city administration in two British cities through an analysis of the impact of social capital. It provides a corrective to the dominant individual-level approach by offering an organisational-level analysis of social capital. The evidence suggests that inter-organisational social capital is not distributed equitably within cities. Voluntary organisations that regularly engage with a city administration can build networks of trust and information flows that outstrip those available to other voluntary organisations. Although it is easier to build social capital within a sector, such as the voluntary sector, building it in tight networks with voluntary organisations would appear to be an achievable goal for a city administration – but such networks do not guarantee an enhanced overall confidence in the local political system.  相似文献

A definition of political culture is posited in which the values that regulate reciprocal altruism constitute a normative system that sustains social solidarity and stabilizes inequalities. These values dampen resentment over unequal rewards by justifying status differences and the exclusion of racial, ethnic, and religious groups, among others, from full participation in social life. Inequality is bolstered by conventional modes of moral reasoning that legitimize explanations for inequality that are embedded in law or emanate from authority.  相似文献

The development and reorganization of mental health services in New Zealand is underpinned by a national strategy, with increased funding from the government, and is occurring on a background of radical change in health service policy and delivery. The major challenge will be to sustain the developments to date, and increase the quality and quantity of services in a climate of ongoing change. A more integrated form of service delivery and funding would potentially enhance the development of population-based mental health services, which will allow the alignment of targeting specialty service to the 3% of the population with the highest need, with a more comprehensive approach to overall mental health service through the primary sector.  相似文献
