Which bank? A guardian model for regulation of embryonic stem cell research in Australia

In late 2005 the Legislation Review: Prohibition of Human Cloning Act 2002 (Cth) and the Research Involving Human Embryos Act 2002 (Cth) recommended the establishment of an Australian stem cell bank. This article aims to address a lack of discussion of issues surrounding stem cell banking by suggesting possible answers to the questions of whether Australia should establish a stem cell bank and what its underlying philosophy and functions should be. Answers are developed through an analysis of regulatory, scientific and intellectual property issues relating to embryonic stem cell research in the United Kingdom, United States and Australia. This includes a detailed analysis of the United Kingdom Stem Cell Bank. It is argued that a "guardian" model stem cell bank should be established in Australia. This bank would aim to promote the maximum public benefit from human embryonic stem cell research by providing careful regulatory oversight and addressing ethical issues, while also facilitating research by addressing practical scientific concerns and intellectual property issues.     

The first Marxist and Fascist economic strategies in comparative perspective

It has become traditional for commentators to characterize economic strategies as either of the ‘Left’ or the ‘Right.’ This has been particularly true in the case of Marxist and Fascist economic systems. This article reviews the history of the first Bolshevik and Fascist efforts in terms of their post-revolutionary economic policies. It considers their respective origins in revolutionary Marxism and proceeds to outline their subsequent economic undertakings. It is argued that a careful study of the logic of their respective rationales together with their subsequent economic strategies reveal a remarkable resemblance both in terms of their operational features and their intended results. How such a reality, generally unappreciated, should be dealt with in terms of present practice becomes both a classificatory as well as an intrinsically cognitive issue.     

Zur Charakteristik Italiens als „verspätete Nation“. Helmuth Plessners Idealtypus und die Diagnose der Gegenwartslage eines EU-Gründungsmitglieds

Italy’s current crisis conceals a sociological issue that deserves qualified attention: The plurality of European modernity. Starting from a critical assessment of Shmuel N. Eisenstadt’s concept of multiple modernities the paper deals with the internal differentiation of the classical model of European modernity. Plessner’s concept of “belated nation” allows a survey of different components and speeds of modernisation processes. Applying Plessner’s model to Italy’s current situation presupposes however to work out more precisely its ideal typical structure and sociological foundation. Furthermore, the normative bias of Plessner’s study on Germany has to be put methodologically in parenthesis, so that Plessner’s analytical frame can be used beyond its original context. First, the article elaborates Plessner’s model ideal typically and differentiates between its political-, economical-, religious-, intellectual- and culture-sociological issues. In the second step, the implicit references to the sociological work of Karl Mannheim and Max Weber are reconstructed. In the third step, the paper evaluates the fruitfulness of Plessner’s approach with regard to its application to Italy’s current crisis. Concluding it retraces the limits of Plessner’s analysis and indicates which further inquiries are necessary to develop an ideal typical concept of the plurality within the European modernity.     

Cross-national investigation and prosecution of intellectual property crimes: the example of “Operation Buccaneer”

“Operation Buccaneer” was the name given to a law enforcement operation against “DrinkOrDie,” a highly organised but globally dispersed Internet-based software piracy group. The concerted enforcement action, led by the US Customs Service and Department of Justice, extended to several European countries and Australia. This paper contrasts the legal consequences that flowed, with numerous suspects pleading guilty in the United States, some contested prosecutions in the United Kingdom, and a sole Australian suspect facing extradition to the United States to face charges. Operation Buccaneer illustrates the cross-national reach of both Internet-based intellectual property crime and the law enforcement response, as well as some of the complexities that arise in applying jurisdictional concepts such as the “double criminality” requirement for extradition in this evolving prosecutorial landscape.     

Drug use in India: Historical traditions and current problems

By all accounts, drug abuse in India — as elsewhere around the world — is reaching near epidemic proportions. Although India has been a world producer of legal drugs for pharmaceutical markets, it also has an ancient tradition of using drugs in daily activities and ceremonial rituals. Only in recent years has this historically drug‐rich country developed a drug abuse problem. Because of its history of tolerance of drug use in culturally sanctioned activities, India offers a rich site for investigating the conditions that foster responsible and irresponsible use of drugs. Global efforts at crop reduction, interdiction, and criminal sanctions continue to be disappointing at best. A more realistic approach may be to identify factors that make drugs particularly alluring to some segments of the population and not to others. This approach emphasized responsible conduct in drug‐rich environments rather than depending on the increasingly unlikely eradication of the supply.     

Microfinancing the Developing World: how small loans empower local economies and catalyse neoliberalism's endgame

Co-finance has steadily grown to provide credit to hundreds of thousands of individuals living in third world countries. The spreading of and innovation within the microfinance sector demonstrates a successful neoliberal initiative that is both socially conscious and economically beneficial. By connecting groups of poor individuals to lending institutions or affluent individuals in developed countries, microloans have been able to foster the strengthening of local economies, necessary for consuming life-improving technology, while incurring minimal risk to the lending party. Criticisms of microfinance—both non-profit and for-profit models—appear misguided as there are clear data demonstrating both a low incidence of default and modest interest rates. Moreover, credit has been the foundation for modern economic growth. Ethical lending to the Third World should therefore not be denied, but rather intensified through the faculty of microfinance.     

Terrorism: The view from Taiwan

Abstract

Pointing out that the circumstances as regards terrorism in Taiwan are far different from those prevailing in, say, Israel or Italy, the authors describe the conditions that have faced the ROC since 1949, the beleaguered fortress mentality, the emergency legislation, and the anti‐terrorist measures, including restrictions on political and civil rights, taken in what may be called a period of protracted crisis. In the authors’ view, the goal of a fundamentally democratic political system will depend to a great extent on outside forces and influences.
