Abstract

The publication of Jon Halliday's A Political History of Japanese Capitalism in 1975 marks a uniquely important event in our understanding of Japan in this country, for it is the first Marxist history in English of a century of Japanese capitalism.     

廉租住房实物配售与配租的效果研究——基于陕西省XX市的调查

实物配售和实物配租是廉租住房补贴实施的主要方式,实证分析两种补贴的政策效果对廉租住房的开展具有重要意义。本文运用效用分析方法,结合陕西省XX市廉租住房住户随机抽样调查获得的数据,对比分析实物配售和实物配租两种补贴方式的实施效果。研究结果表明,两种补贴方式均提高了受补贴家庭的消费效用水平,但效用增加量的大小与住房消费获得的效用占总消费获得效用的比重r相关:当r小于0.5974时,实物配租的效用增量大于实物配售;当r大于0.5974时,实物配售的效用增量大于实物配租。研究表明廉租住房建设过程中,应当适当考虑其建设地点或完善小区周围的学校等公共设施。现阶段两种补贴方式在廉租住房保障中都能够发挥一定的作用。因而政府通过建设廉租住房解决家庭住房困难问题,可以采取实物配租和实物配售相结合的方式。两种方式的具体选择可以依据住房消费效用占家庭消费总效用的比例来确定。     

“物”与族群形象的建构——从“苗银”说起

当前流行的"苗银"一词是一个模棱两可的说法。在黔东南地区,苗族银饰的佩戴有其传统与文化,明清起则以白银硬通货为原料制作银饰。白铜作为替代品有其产生渊源,但不能替代苗族银饰的文化精髓。用"苗银"来称呼白铜饰品,和用盛装女子指代苗族一样,是伴随权力与资本的话语制造。     

过境货物的知识产权边境执法措施研究

将边境执法措施扩展到进出口之外的过境环节是发达国家强化知识产权执法的新趋势.这一严厉措施引起了许多问题和争议.在国内法层面,多数国家并未赋予知识产权权利人控制过境行为的实体权利,针对过境货物的边境措施缺乏实体权利的支撑.在冲突法层面,由于过境货物特殊的法律状态,很难根据现有的知识产权法冲突规则协调货物过境国、来源国与目的国的法律适用解决法律选择问题.在国际法层面,针对过境货物的边境措施与世贸体制下就相关问题达成的多边协定,是否一致也存有很大疑问.由于面临诸多问题与争议,这一措施能否获得全面接受尚属未知,仍需进行一定调整.     

行政法视野下我国非政府组织合法性危机及其矫正

随着经济和社会纷纷步入转型期,我国社会的权力结构发生了变化。非政府组织的兴起改变了原来政府———市场的二元治理结构,推动着我国治理理念的转变以及民主法治的进步。然而,非政府组织蓬勃发展的同时也面临着内外交困的局面,从而引发了一系列的危机,尤其是合法性危机:一来其权力的来源缺乏明确的法律依据,二来缺乏代表性,再来独立性也受质疑。从行政法的视角分析了我国非政府组织合法性危机,并试图探索出解困之策。
