CDU refugee policies and the landesverband oder/neiße: Electoral tool or instrument of integration?

Despite the recognition that the integration of refugees and expellees into west Germany has been one of the success stories of the post‐war period, little light has been shed on the process of political integration of this group into the political system of the nascent Federal Republic. As the ‘newcomers’ were prevented from organising themselves in political or cultural organisations, the only legitimate way of exercising political influence was the way through the licensed parties. The CDU/CSU as a conglomerate of liberal and conservative traditions made use of its historic opportunity to adapt its flexible party apparatus and encourage refugee participation. Thereby, it made an important contribution to the political representation of refugee demands as well as attracting a large proportion of the newcomers’ votes.

网络故障损失的类型判断——以“北京大兴案”为例

保障网络接入的畅通是网络接入服务商的主要合同义务。因故障导致网络接入阻断或不畅给用户造成的经济损失应当由网络接入服务商承担赔偿责任,虽具备理论上的依据,但用户最终是否可以取得赔偿,还要取决于这种经济损失是否具有法律上的可赔偿性。从对损失类型的规定分析,该类损失既包括期待利益的损失,也包括信赖利益的损失。这两类损失的赔偿,在合同法中均有相应的依据。

Entrapped on the Web? Applying the Entrapment Defense to Cases Involving Online Sting Operations

Many law enforcement agencies are currently responding to the problem of online crime by establishing proactive investigative units that track criminals on the Internet. Not only do these specialized teams face problems in the area of emerging technology, they are also faced with handling emerging legal issues. The current research examined the issue of the entrapment defense, and how previously established physical realm doctrine could be applied to the investigation of online crimes such as child pornography. Relying on previous case law it would appear that entrapment claims related to online sting operations involve consideration of: a) did the law enforcement officer continuously contact the suspect with the intention of trying to convince the individual to engage in a particular type of behavior, b) how long was the relationship between the undercover officer and the suspect, and c) how much, if any, reluctance to commit the criminal act did the suspect provide evidence of?     

School liability for student injury from school violence: comparison between South Korea and the USA

This paper examines school liability for school violence-related student injury in South Korea and the US. The study found that the US courts considered only violence-related behaviors of the perpetrator when judging whether violence can be foreseen; thus drug abuse or verbal abuse by the perpetrator were not considered as a part of his/her violent history. On the other hand, the Korean courts considered perpetrators’ nonviolent behavior, such as low academic achievement or negative attitudes toward academic work, as indicators of violent history. Regarding the extent of school liability, while in Korea, schools were not held responsible for injuries to non-school-related persons caused by their students’ violent acts in public, in the US, the court required schools to take legal responsibility for such cases happening during field trips. These findings help to reconsider school liability for school violence and generate suggestions for more reasonable and universal legal standards.     

朝鲜的变化与中朝关系--从"传统友好合作关系"到"实利关系"

中国和朝鲜关系自1999年开始恢复,这虽不表示两国已恢复过去的同盟关系,但一定会对朝今后的发展起到积极作用.本文首先介绍中朝关系的变化;然后分析在向朝鲜提供改革模式及理念、经济资源、政治军事援助过程中,中国对朝鲜变化产生的影响;最后得出主要结论,即虽自20世纪90年代后期开始,朝中关系正式进入恢复阶段,但双方关系不再以共享理念和战略目标为基础,而是基于现实利益或战术目标.朝中关系这一新特点将继续制约中国对朝鲜变化过程的影响.此外,文章还针对朝鲜的发展变化,就中韩合作问题提出了若干建议.     

农民工子女:类型分化及其社会融入的制度逻辑

农民工子女的类型分化近年日渐明显,导致他们的社会融入需要也逐步呈现多元趋势.但是,传统的社会融入理论与制度安排,都还没有做好充分准备,以至很难指导与规范实践层面问题的妥善解决.从社会公平立场看,以农民工子女的内生需要为基本依据,建立健全分门别类的差异化补偿制度及其实现机制已经势在必行.     

我国人民民主面临的问题及对策——基于协商民主视角的分析

人民民主是社会主义民主的核心要义,是中国共产党和当代中国的理想和追求.我国设计了以人民代表大会制度为标志的一系列制度措施来实现人民民主,但在具体的政治实践中却面临种种问题.协商民主是强调讨论对话和审议的民主形式,恰好在某种程度上弥补了目前我国人民民主实践的不足.
