Functional mental capacity is not independent of the severity of psychosis

BACKGROUND: Function-specific mental capacities are the legal criteria for competence. These are regarded as superior to clinical assessments of mental state and general function. AIMS: To determine whether tests of fitness to plead and capacity to consent are independent of each other and independent of mental state and global function in psychosis. METHOD: The MacCAT-T and MacCAT-FP, PANSS and GAF were administered to 102 compulsorily detained forensic patients with psychosis. Criteria for incompetence were inability to express a preference concerning treatment, and independent rating as unfit to plead. RESULTS: MacCAT-T, MacCAT-FP totals and sub-scales correlated with each other and with PANSS and GAF. Those independently rated unfit to plead or who were incapable of making a treatment choice scored significantly worse on all rating scales. No test had satisfactory sensitivity or specificity. CONCLUSIONS: Legal definitions of mind and of functional capacity offer a basis for structured clinical judgement regarding decision-making capacity. However, function-specific measures of understanding, reasoning and appreciation generate much the same results as measures of mental state and global functioning.

Tracing the Gordian Knot: Indeterminate‐Sentenced Prisoners and the Pathologies of English Penal Politics

This article explores some of the key pathologies of English penal politics by applying an interpretive political analysis perspective to the specific issue of the plight of the ‘prisoners left behind’, the thousands of indeterminate‐sentenced IPP (imprisonment for public protection) prisoners who remain incarcerated, notwithstanding the abolition in 2012 of this sentencing option targeted at ‘dangerous offenders’. The article draws on research findings from an ESRC funded study of penal policymaking to examine why the Gordian knot of the prisoners left behind has proved to be so hard to untangle. The broader lessons of this specific story are then set out. In particular, it is argued that the public and political debate around criminal justice has become damagingly narrow over recent years.     

Future Prospects for Public Housing in the United States: Lessons From the Rental Assistance Demonstration Program

This article provides an overview of the Rental Assistance Demonstration (RAD) program in the United States and examines its early implementation from its start in 2013 through April 6, 2016. RAD was devised to address the physical deterioration of public housing and secure a more stable funding stream. It requires public housing authorities to shift properties out of the public housing program into a different subsidy program (project-based Section 8) which enables them to obtain mortgages on more favorable terms and to secure tax-credit investment. The program is currently limited to 185,000 housing units. As of April 6th, the program was fully subscribed, and had generated more than $2 billion in new investment. Extrapolating from the early results, RAD has the potential to yield more than $15 billion for fund the redevelopment and renovation of public housing.     

Personal Identity Development in Hispanic Immigrant Adolescents: Links with Positive Psychosocial Functioning,Depressive Symptoms,and Externalizing Problems

The present study was designed to examine trajectories of personal identity coherence and confusion among Hispanic recent-immigrant adolescents, as well as the effects of these trajectories on psychosocial and risk-taking outcomes. Personal identity is extremely important in anchoring young immigrants during a time of acute cultural change. A sample of 302 recently immigrated (5 years or less in the United States at baseline) Hispanic adolescents (M_age?=?14.51 years at baseline; SD?=?0.88 years, range 14–17) from Miami and Los Angeles (47?% girls) completed measures of personal identity coherence and confusion at the first five waves of a six-wave longitudinal study; and reported on positive psychosocial functioning, depressive symptoms, and externalizing problems at baseline and at Time 6. Results indicated that identity coherence increased linearly across time, but that there were no significant changes in confusion over time and no individual differences in confusion trajectories. Higher baseline levels of, and improvements in, coherence predicted higher levels of self-esteem, optimism, and prosocial behavior at the final study timepoint. Higher baseline levels of confusion predicted lower self-esteem, greater depressive symptoms, more aggressive behavior, and more rule breaking at the final study timepoint. These results are discussed in terms of the importance of personal identity for Hispanic immigrant adolescents, and in terms of implications for intervention.     

Friendship,Recognition and Social Freedom: A Sociological Reconstruction

In Freedom’s Right, Axel Honneth articulates the social freedom of friendship with reference to its institutionalised norms. These action norms, however, are not specific to friendship; they apply to modern intimacy per se. Such non-specificity cannot adequately account for the experience of social freedom in friendship. Addressing this issue, I evaluate friendship as a form of recognition and identify a generative recognition deficit functional to its relational autonomy. Then, taking Honneth’s institutional approach to friendship as a point of departure, I ascertain an institutional deficit that both sustains friendship’s autonomy and constrains the generalisability of its social freedom by way of institutional connectivity to heterosexuality. I suggest that only a differentiating approach to friendship that fathoms its extraordinary position among interpersonal relationships can yield new insights. That done, friendship can in turn provide a prism through which to assess the conceptual approaches deployed in its analysis.     

The Future of Memory

Reaction to David Rieff’s book is bound to be mixed. Its particulars are brilliant; its flaws, profuse. In Praise of Forgetting is misleadingly titled, for Rieff focuses primarily on the social functions of memory and its relation to history and forgetfulness. In his view, every event and person, no matter how notable today, will be ultimately forgotten. But in the short run, forgetfulness is benign, leading to reconciliation and peace. Memory, in contrast, is always malignant and distorted, yet so influential as to merge with and erode history. Rieff's assertions are matched against the cases he himself adduces, cases which he describes selectively and with minimal regard for evidence. However tendentious his arguments, the insights and vast erudition to which David Rieff treats his readers are undeniable.
