In JBl 2010, 487–495, wurde dargelegt, dass der anerbenrechtliche Nachtragsanspruch der weichenden Geschwister (Miterben) gegen den Hofübernehmer sich nach b?uerlichem Gewohnheitsrecht beurteilt, dass also bei Wegfall der Rechtfertigung für den begünstigten übernahmspreis wegen gewinnsüchtiger Ver?u?erung des Hofes (oder von Hofliegenschaften) durch den übernehmer der Mehrerl?s auf die Miterben (weichenden Geschwister) nach dem Hofübergeber aufzuteilen ist. Der Nachtragsanspruch geh?rt also noch zum begrifflichen Umfang und Inhalt des nach b?uerlichem Gewohnheitsrecht zu bestimmenden begünstigten übernahmspreises (Wohlbestehenswertes). Die Fristen für den Nachtragsanspruch sind nach b?uerlichem Gewohnheitsrecht auf folgende Weise zu formulieren: Die Ver?u?erung des Hofes (oder von Hofliegenschaften) muss in die mit etwa 15 Jahren zu bestimmende Frist ab Hofübergabe an den Hofübernehmer fallen, die mit der Hofübergabe zu laufen beginnt. Dieser Anspruch kann nur nach Tod des Hofübergebers geltend gemacht werden, bei einer Frist für die gerichtliche Geltendmachung von 3 Jahren ab erfolgter Ver?u?erung (Einverleibung) durch den Hofübernehmer.  相似文献

In principle, reporting by state and local governments to thefederal government is essential to the design and implementationof national policy. In practice, reporting often engenders resentmentof federal intrusion and is often dismissed as a waste of stateand local resources. Is reporting useless? Does it strengthenthe federal government at the expense of state and local governments?We asked federal, state, local, and site officials about thevalue and burden of five specific reporting systems in elementaryand secondary education. Common assumptions about reportingdid not correspond to respondent reactions. Both value and burdencascade through the intergovernmental system, reaching policymakersin all governments. Although critics seldom discriminate betweentypes of reporting, we found that reporting designed to improvecompliance with federal standards evoked different judgmentsof value and burden than reporting designed for assistance.These results suggest some new approaches to federal policygoverning the collection of information and to the design ofindividual reporting systems.  相似文献

This study examined the influence of pubertal timing upon family interactions in normal and psychiatric adolescent samples. An important feature of our approach is its emphasis upon micro-analysis of family behaviors (individual speeches) and family processes (theoretically specified speech pairings). Rather than assume that global family patterns (e.g., power) shift in response to pubertal changes, we follow how types of speeches and speech sequences are associated with different pubertal timing. Using the previously constructed family coding system, the Constrainig and Enabling Coding System, we found that on-time adolescents and their parents differed from both off-time groups (early or late). Abstract. The decline in support for traditional political parties in a number of Western democracies is often attributed to the effects of recent educational expansion and a consequent rise in cognitive mobilisation in the electorate. The thesis that support for the two major parties in Britain is lowest among the young educated is tested here, using survey data for the period 1964–1983. The analysis indicates that for only a short time in the early 1970s was there evidence of such a relationship, and that differences in major-party support which are related to age and to educational achievement have all but disappeared by the 1980s. Moreover, the findings cast serious doubt upon the validity of current operationalisations of 'cognitive mobilisation'.  相似文献

Starting from the stylised fact that federal institutions are held to be inimical to welfare state expansion, this paper examines the ways in which federalism has shaped the dynamics of welfare state development in Switzerland and Austria. A comparison of these different federal polities reveals that the welfare breaking effect attached to federalism crucially depends on the extent of vertical power separation. In both countries economic competition among constituent units did not fuel a race to the bottom in social standards. In Switzerland, the most important reason connected to federalism for why federal social policy was delayed and downsized was policy-preemption by the cantons and their considerable influence on the federal policymaking process. In contrast, the Austrian Länder neither had major social policy competencies nor an effective veto power which allowed them to block the centralisation of public policy. Instead, federalism is subordinate to the partisan arena at the central state level which itself is dominated by political parties quite favourable to welfare state expansion.  相似文献
