Juvenile Justice and the 'Shift to the Left'

The notion of 'shift' is used as a symbol for procedure in criminal cases, understood as a sequence of legal interferences by the police, the prosecution and by proceedings in court. If this sequence is symbolised by a horizontal line, the procedural stages move from left to right. But the distribution of competences has recently lost its prior balance, due to 'modern' crime and society: The functions of the judge appear reduced, whereas the range of action of the prosecution has widened; also the police has gained more influence. On the symbolic line of procedural stages this all makes for a 'shift to the left'. This paper deals with the question as to whether juvenile justice is undergoing the same changes. The first answer is 'yes', based on the enlarged diversionary competence of prosecutors and the police. From a different perspective, however, juvenile offending is a 'natural' phenomenon connected with young age, which a priori places juvenile justice on a 'left' position of the imagined line. A plea is made for this juvenile justice to stick to its inherent concern for young offenders individually and not to sacrifice this to collective interests in public order and safety.

‘We are Scared to Say No’: Facing Foreign Timber Companies in Sierra Leone's Community Woodlands

In recent years, ‘decentralisation’ has become an increasingly prominent theme in Sub-Saharan African development theory and practice, particularly around woodland management. Although much research has illuminated challenges arising in project design and implementation, ‘external’ threats to decentralised resource management initiatives have received little attention. At the same time, however, there has been a massive increase in foreign, particularly Chinese, corporate investment in the extraction of African resources. This paper examines the importance of the interaction between these two trends to local livelihoods and resource management through a case study of illegal logging by Chinese companies in Sierra Leone.     

The transnational political engagements of refugees: Remittance sending practices amongst Somalis in Norway

This article aims to provide insight into the transnational political engagements of Somalis in Norway, and focuses mainly on their financial contributions. Such an aim is inspired by the increased interest in the transnational political engagements of diaspora groups, which has not yet been matched by sufficient empirical research on the topic. The Somali case is particularly interesting, considering the effective state collapse and ongoing civil war as well as the salience of local level security providing mechanisms. The first part of the article comprises an overview of different types of political transnational activities refugees engage in and the second part discusses the empirical study. Interestingly, though not surprisingly, the main political engagements of the Somali community in Norway do not take place through interaction with ‘the state’ or transitional state institutions; rather, they occur on a sub-national level, not only in the political domain but also through humanitarian initiatives.     

Violent women: a multicentre study into gender differences in forensic psychiatric patients

To gain insight into the relatively small, but increasing group of women in forensic psychiatry, a retrospective multicentre study was started gathering information from the files of 275 female patients of four Dutch forensic psychiatric hospitals on characteristics and violence risk factors. Overall, a picture emerged of severely traumatized women with complex psychopathology with multiple previous treatment failures and many incidents during treatment. The present study investigates specific psychiatric and criminal characteristics of female patients by comparing their data to those of 275 male forensic psychiatric patients. Various prominent differences were found, for example, women had more complex histories of victimization, were more often diagnosed with borderline personality disorder, were more likely to commit homicide and arson and less likely to commit sexual offenses, and were more often involved in inpatient aggression than their male counterparts. Several recommendations for gender-responsive treatment and directions for future research are provided.     

Complex brain malformation as a rare cause of neonatal death

A dead female neonate was brought to a children's hospital by the mother. The MRI scan suggested a malformation of the brain. Because of the other circumstances of the case (the mother left the hospital unauthorizedly), a forensic autopsy was ordered, in the course of which the brain was removed while the head was totally immersed in water. This method, which was introduced by Prahlow et al., helps to obtain intact brain specimens without interfering with the necessary medicolegal preparations to determine whether the child was born alive. Neuropathological examinations classified the cerebral malformation as (lethal) lissencephaly. Further investigations showed that the mother had lived in Germany without a residence permit.     

Comparison of German population data on the apoB-HVR locus with other Caucasian, Asian and Black populations

A population study of 505 unrelated individuals from Southwestern Germany was carried out on the 3′-apoB hypervariable region (HVR). After amplification via polymerase chain reaction (PCR) and agarose gel electrophoresis, 15 different alleles and 47 genotypes were observed. The most common alleles were hypervariable elements (HVE) 37 and 35 with an allele frequency of 0.374 and 0.244, respectively. The heterozygosity index was calculated to be 78.4%. Allele frequencies of this study are compared with results from other databases obtained from a French, a Spanish, an Asian and an American (Black) population.     

Exporting ‘active citizenship’: foreign support for citizenship education in the Arab world

What explains the rise in support for active citizenship programs in the Arab region? How has active citizenship been envisioned and taught with support by foreign states? How do participants understand the usefulness and impact of such programs? In this paper, we examine the contexts in which citizenship programs that embody the political aspirations of foreign states, are implemented. Embedded in local political realities, participants in these programs routinely question the ef?cacy and applicability of training modules focused on active citizenship and civic engagement. We argue that the proliferation of active citizenship programs for civil society organizations in practice serves to both bolster state legitimacy and discourage community leaders and activists from expressing political dissent. By submerging con?icting values, practices, and perspectives while encouraging civic participation based on conformity rather than dissent, active citizenship programs risk fostering a depoliticized civil society that is detached from the local political context.
