知识产权由主体、内容和确认构成.内容包含的是永恒的信息,主体存在于人类社会中,内容存在于精神世界中,权利随着确认的完成降生于人类社会中.在这个过程中,物质世界充当了载体和工具,社会和国家充当了裁判者和护卫者.     

An Altered Pattern of Economic Growth

CHINA'S economic boom has been a focus of world attention For more than a decade. Its GDP having increased almost 13-Fold in the past 15 years, economy and development are two of the most Frequently heard buzzwords in the Chinese media. China is also holding its own within the global economy. and in 2004 was the number one contributor to global trade growth. Products "Made in China" are to be seen in every country in the world, as are Chinese investors. The rapidly growing Chinese economy has indisputably brought with it improvements to living standards, but has also engendered social problems. At the Fourth Session of the Tenth National People's Congress. Chinese Premier Wen Jiabao listed in his 2006 government work report the problems that have emerged in the past five years of economic and social development. They are: an irrational economic structure; lack of motivation to innovate: excessive consumption of energy resources; alarmingly high environmental pollution; uneven regional development and a widening income gap; and sluggish promotion of social welfare. In order to solve these problems, the Chinese government has proposed a new pattern of economic growth whose emphasis is on social development and conserving energy and resources. Within this new development mode, economic growth will depend less on resource consumption and more on technological and human resources. In the past, the government sacrificed rural interests in order to boost industrial development in urban areas. Its current plan is to invest in and channel funds towards stimulating the rural economy, and also to make various public services available throughout China's vast countryside.

《循环经济法》之定位探析——兼与梁毅雄先生商榷

如果《循环经济法》定位不准确,将会成为以发展循环经济为借口,以环境资源为代价的污染大法。《循环经济法》主要属于环保法范畴,而不是经济法;是循环经济法律体系中的基本法、牵头法;《循环经济法》要软硬兼施,充分发挥基本法指导性和宏观调控的作用。     

Fiscal Decentralization,Flat Administrative Structure,and Local Government Size: Evidence and Lessons from China

This paper examines the effects of fiscal decentralization and flat administrative structure on local budget size and program outlays. We test three related theoretical hypotheses in China's adoption of province‐over‐county scheme of financial administration. We provide evidence that both decentralization of expenditure and decentralization of revenue increase the size of local budgets; that the impact of the former far outweighs that of the latter with local budgets on a rising trajectory; and that discretion grants localities more means to increase their budget. These results show that as China's reform deepens the proportion of local outlay on administration declines because of more local discretion from eliminating the prefecture bypass between the province and counties. But neither decentralization nor increased local discretion has allocated more local resources for education, and both contribute to increasing outlay on economic development.
