Jury nullification is a mechanism, and a defense, which allows the jury, as representatives of the community, to disregard both the law and the evidence and acquit defendants who have violated the letter, but not the spirit of the law. Should juries simply follow the law as articulated by the trial judge, or should they act as “conscience of the community,” and neglect the strict requirements of the law when it would lead to unjust or inequitable verdicts? The present study was aimed at providing empirical data for the following question: will the jury operate in a manner which is different than its normal functioning if given explicit nullification instructions? Three nullification instructins varying in explicitness as to nullification were combined with three criminal cases to yield a 3×3 factorial design. Forty-five six-person juries (270 subjects), were randomly assigned to the nine experimental groups. The results showed that juries given explicit nullification instructtions were more likely to vote guilty in a drunk driving case, but less likely to do so in a euthanasia case. The third case, which dealt with murder, did not show any differences due to instructions. Juries in receipt of nullification instructions spent less deliberation time on the evidence and more on defendant characteristics, attributions, and personal experiences.  相似文献

The factors influencing court readiness to implement programs for divorcing families that are evidence based (i.e., have received support as being effective in scientific trials) were examined in a stratified random sample of the 3, 140 U.S. counties. Represented in the final survey were 22 large, 58 medium-sized, and 74 small counties with established divorcing parent education programs. For each court, a telephone interview was conducted with a key informant. Results indicate that 95% of counties report that implementing a lengthier, empirically validated program would be helpful to families, would find support from judges (80%), should be done in their county (74%), would find funding (73%), and was the responsibility of the court (69%). The two important barries to implementing longer evidence-based programs are potential funding problems and parents' potentially low attendance.  相似文献

Governments create the political and economic environment in which their countries' businesses operate, usually described as the ‘enabling environment’ or ‘investment climate’. In response, business associations seek to influence public policy to make it easier for their members to “do business”. Scholars suggest that interest groups are able to form lasting relationships with governments based on a resource exchange mechanism. This paper suggests that, at least in developing countries, a more nuanced explanation is necessary. Business associations, in particular, need proactively to pursue a logic of ‘competence’ as well as a logic of ‘positive relationships’. This paper assesses the outcomes of advocacy projects undertaken by business associations in Kenya in the period 2008–2013, considers the degree to which the associations contributed to the decision to change policy and then analyses the factors perceived by business associations to have led to their success in influencing public policy. We find evidence to support the expectation that business associations must develop a wide range of competences whilst building relationships with multiple stakeholders. Lesbian, gay, bisexual, and trans (LGBT) human rights are often assumed to travel from the core to the periphery, namely from the Global North to the Global South. However, these rights flows and resistances are more complex than a unidirectional model might suggest. Using a transnational perspective, we consider resistances to LGBT rights in places where LGBT rights are supposedly assured. In Canada and Great Britain, where various forms of equities legislation for LGBT people have been enacted, there is an increasing opposition to LGBT gains. The transnational circulation of these oppositional discourses can be seen in how Canadian and British organizations talk to, and about, each other and illustrate transnational networks that create resistances in the places where “we have won.” This questions a sole focus on resistances in places that do not have LGBT equalities legislation, usually those outside the Global North and associated with “less developed others.”  相似文献

I explore whether newspapers that represent regions experiencing "local casualties," that is, fatalities from an international violent event, give greater coverage to the incident. Research suggests that local casualties influence domestic politics, yet scholars have given little attention to either the influence of local casualties on reporting or the impact of international events on local press coverage. I examine the effect of local casualties on local media by analyzing the frequency of newspaper coverage of the October 2000 terrorist bombing of the USS Cole. Using a variety­ of techniques, including random effects logit and repeat failure hazard analysis, I find that newspapers from areas that experienced casualties from the Cole attack were more likely to report on the bombing, even when controlling for paper-specific and temporal effects. Driven by community casualties, variation in local media atten­tion to an international news story may help to explain why the effects of international events on individual attitudes and domestic political effects vary geographically, a necessary condition for institutional arguments for the democratic peace.  相似文献
