Abstract. 'Deregulation' is best conceived as covering two separate sets of processes: changes to the structure of rules embodied in regulatory systems; and disturbances to the stability of those systems due to the inability of system 'governors' to function effectively. The most striking feature of deregulation is variety - in incidence, form and extent. This variety is a function of three broad sets of variables: place, notably national setting; time, notably the historical epoch and the stage in a regulatory cycle when deregulation happens; and arena, notably the economic arena and policy networks where deregulation takes place.  相似文献

Western scholars have argued that image making and image management are a preoccupation of the judiciary. Images of the judiciary may take a variety of forms and be produced for kinds of audiences. One form of judicial image making and image management is live performances in the courtroom and other court settings. Another is the written judgment where the preoccupation is the style of the written text. Press and other mass media reports of judicial activity are another. The audience for judicial images is equally diverse, from fellow judges, lawyers in the courts and the wider legal community, the litigants before the courts to the executive, legislature and the public both in the courtroom and beyond. The image of the judiciary that is available to the public has a particular significance in Western rule of law democracies. As a general rule courts and the judiciary are required to operate in public and their activities must be open to public scrutiny. A recent policy manifestation of this goal is debated about confidence in the justice system and initiatives designed to improve confidence. In the majority of cases public scrutiny of judicial activity and public confidence in the judiciary relies upon the media. Objective and accurate press and media reports play a key role in shaping public understanding of the judiciary and generating or undermining confidence in that institution. Reports in regional and national newspapers have long been an important source of information, shaping public knowledge and facilitating public scrutiny of the justice system. In the UK, there is almost no scholarship on these representations past or present. The result is little known about the representation of the courts and the judiciary in press reports. Little is known about what the diligent reader of these reports can learn about judicial activity. The aim of this article is to take a first step towards changing that state of affairs. The literature on public management reform exhibits two intertwined convergence myths. First, a world‐wide consensus on a new public management (NPM) reform agenda is seen to exist amongst policy reformers and practitioners. If this agenda is not fully implemented in all cases, this is generally explained by political and reform setbacks rather than disagreement on policy aims. Second, this NPM agenda is now seen as challenged and even abandoned and replaced by an emergent post‐NPM or ‘public value leadership’ agenda and/or policy paradigm. We show the NPM convergence is overstated, with a remarkable resilience of existing institutions, and a diversity of public management systems. On the other hand, even within NPM exemplars that have putatively now adopted a post‐NPM agenda, there is debate to what degree NPM has been abandoned, and over the novelty, coherence and resilience of the post‐NPM agenda. Divergence and contextual variation prevail. The role of myth in policy reform is further examined.  相似文献

The banking crisis of 2007-2008 briefly threatened to overturn a system of market government that had lasted for nearly three decades—a system designed to minimise democratic control over markets. The crisis drew politicians once more into financial politics and exposed bankers and banking institutions to popular criticism and control. But the development of regulatory debates, and of the institutions designed to manage the crisis, have combined to avert this threat to the established order. The crisis is being 'wasted': it is failing to produce radical reforms. The paper establishes the intellectual and institutional origins of this failure, and argues that, while the reform window is closing, it is not yet fully shut: there exists yet scope for radical argument and popular mobilisation in the creation of a financial system with fewer pathological features.  相似文献
