Prior theory and research on sentencing oversimplify the role of race, gender and age in judicial decision making. In this article we present a "focal concerns" theory of judicial decision making to frame hypotheses regarding the effects on sentencing of these social statuses, both singly and in combination. Analyzing statewide sentencing outcomes in Pennsylvania for 1989–1992, we find that, net of controls: (1) young black males are sentenced more harshly than any other group, (2) race is most influential in the sentencing of younger rather than older males, (3) the influence of offender's age on sentencing is greater among males than females, and (4) the main effects of race, gender, and age are more modest compared to the very large differences in sentencing outcomes across certain age-race-gender combinations. These findings demonstrate the importance of considering the joint effects of race, gender, and age on sentencing, and of using interactive rather than additive models.  相似文献

This study tests the effects of neighborhood inequality and heterogeneity on crime rates. The results of this study, which were obtained by using a large sample of census tracts in 19 cities in 2000, provide strong evidence of the importance of racial/ethnic heterogeneity for the amount of all types of crime generally committed by strangers, even controlling for the effects of income inequality. Consistent with predictions of several theories, greater overall inequality in the tract was associated with higher crime rates, particularly for violent types of crime. Strong evidence revealed that within racial/ethnic group inequality increases crime rates: Only the relative deprivation model predicted this association. An illuminating finding is that the effect of tract poverty on robbery and murder becomes nonsignificant when the level of income inequality is taken into account; this finding suggests that past studies that failed to take income inequality into account may have inappropriately attributed causal importance to poverty. This large sample also provides evidence that it is the presence of homeowners, rather than residential stability (as measured by the average length of residence), that significantly reduces the level of crime in neighborhoods.  相似文献

This article considers change in academe in Sweden and England, focusing on gender equity and the new public management reforms. In drawing on social movement theory, it is argued that public sector agendas in these countries have been affected by the influences of their respective women’s movements as well as by the new public management. The article explores these developments through the experiences of a group of employees whose voices are heard infrequently in the literature, those in middle‐level academic positions in universities who are responsible for delivering change. It is argued that the rational, hierarchical, masculine discourses of the new public management offer challenges to women’s movement supporters, whose influences and responses are examined. It is contended that the use of social movement theory, as a vehicle through which to conceptualize change, offers a number of insights. These are: the contribution made to gender equity by women who are not self‐defined feminists or strongly committed to equal opportunities, known as femocrats; the contribution made by some supportive men to gender equity; and the potential for future collective opposition to the new public management from women’s movements.  相似文献

This study addresses one point in neutralization theory. It is often maintained that techniques of neutralization relieve moral constraints which allow for individuals to commit delinquent behavior. Drawing on the body of knowledge concerning vocabularies of motives, it is argued here that motives in deviancy theory should not be viewed in such positivist/causal terms. Techniques of neutralization are motives which are more accurately utilized after behavior is committed and only when such behavior is called into question. It is also argued that the use of motives and the types of motives should indicate the degree of conflict involved in the question situation.  相似文献

Nearly 400,000 Africans may have been killed in racially motivated, lethally destructive, state supported, and militarily unjustified attacks on the farms and villages of the Darfur region of Sudan. Using victimization survey data collected from Darfurian survivors living in refugee camps in Chad, and drawing on conflict theory, we present evidence that the Sudanese government has directly supported violent killings and rapes in a lethally destructive exercise of power and control. In the language of the Geneva Genocide Convention, these attacks have inflicted on African tribal groups "conditions of life calculated to bring about their physical destruction in whole or in part." The data include explicit evidence of the central mediating role played by racism in the attacks. There is little or no evidence from the surveys to support the claim of the Sudanese government that the attacks have been aimed at rebel groups as a counter-insurgency strategy. The Sudanese government claims are by this analysis not credible as self-defense arguments, but rather of the exercise of power and control through denial. Further forms of such denial are considered, including the slowness of modern American criminology to advance the study of genocide.  相似文献

Four traditional criminological theories—opportunity, control, subcultural, and differential association—are tested for their explanatory power in accounting for organizational compliance with regulatory laws. The primary data source is interviews with 410 chief executives of small organizations. Partial support is found for each theory; certain key concepts of each theory have a significant effect on regulatory compliance, net of a variety of characteristics of the nursing home, the residents in the home, and the inspection team. The results show that blocked legitimate opportunity has a significant effect on regulatory compliance, as does the structure of illegitimate opportunity. There is also an effect on compliance of participation in business subcultures of resistance to regulation. Belief in laws increases compliance with those laws as does differential association with or attachment to the upholders of the law. Overall, however, control theory and differential association lack explanatory power, and the explanatory power of subcultural theory is modest. Only opportunity theory explains a credible proportion of variance in compliance as a standalone theory. The significant effect of some but not all of the measures for each theory, coupled with the lack of significant explanatory power by three of the four theories, suggests the need for theoretical integration.  相似文献

Research Summary: Using panel data from 188 large cities during 1980–1999, we examined the possible homicide promoting effects of “three‐strikes” laws. Results indicated that cities in states with three‐strikes laws experienced short‐term increases in homicide rates of 13% to 14% and long‐term increases of 16% to 24% compared with cities in states without the laws. Policy Implications: Our results emphasize the fact that rarely are the possible unintended negative consequences of policy directives considered and point to the need for policy makers to consider both intended and unintended consequences of policy directives before the directives are codified.  相似文献
