Upon entering the legal realm, the expert witness must begin to define his or her role and establish a working relationship with the attorneys. The authors recommend that relationships between the social scientist and the attorneys be subject to clear and explicit agreements and that the role of the expert witness be defined so that the social scientist maintains control of any needed research. Potential expert witnesses should be aware of the unique research problems they may encounter and be prepared to deal with these obstacles. Throughout the research, the expert should be cognizant of the adversarial setting in which the results will be presented, and must carefully document and substantiate the research accordingly. Michigan created a family court in 1998, combining in a single court jurisdiction over most family law cases. This study examines the child welfare workers' role in creating the family court, the family court's impact on child welfare workers' practice, and child welfare workers' efforts to educate other professionals on the potential benefits of the family court system. This study found that child welfare workers were not actively involved in the creation of the family court and have not aggressively sought to educate other professionals regarding the family court's potential. In this article we evaluate whether the Supreme Court's much-discussed decision in Chevron v Natural Resources Defense Council (1984) signaled a lasting difference in how the justices decide administrative law cases, by comparing and testing the predictions of three distinct theories of Supreme Court behavior. The legal model predicts an increase in deference to administrative agencies. This prediction is shared by the jurisprudential regime model, which also predicts that the justices evaluate key case factors differently before and after Chevron . The attitudinal model predicts no change in the justices' behavior as a result of Chevron . Although we find that attitudes matter, the fact that we also find support for the legal and jurisprudential regime models undermines the assertion of the attitudinal model that law cannot explain Supreme Court votes on the merits. 相似文献
