Soft power, like so much else in relations between the People's Republic of China and Taiwan, is asymmetrical and freighted with implications for U.S. policy and U.S.-China relations. For China, soft power largely serves—or strives—to reduce alarm (or at least reaction) among other states concerned about China's new-found hard power or, perhaps more realistically, the hard power that China's economic rise can underwrite. Much of the value for Beijing of soft power is—and is likely to remain for quite some time—its potential contribution to reducing the likelihood that other states will react to China's rising hard power in ways that could threaten China's interests.  相似文献

Amnesties constitute the most contentious issue in transitional justice processes. While largely rejected for contravening international law and being morally objectionable, political realities may sometimes force us to accept them in the interest of peace and stability. Determinations about the desirability and effectiveness of amnesties to promote peace thus need to look beyond legalistic claims, and take into account the specific political context within a country, as well as the nature of the amnesty itself. Taking the case of Algeria, where an amnesty was adopted in 2005 with the Charter for Peace and National Reconciliation, this article argues that although the amnesty can be justified partially by the fragile political context in Algeria and may contribute to reducing levels of violence in the country, its effective contribution to peace and reconciliation will be limited because it has, so far, not been accompanied by other political and economic measures necessary to bring peace and stability to the country, and because it promotes amnesia and largely ignores the plight of the victims of the war.  相似文献

In 1997 the FDA published a set of regulations for the pharmaceutical industry intended to establish controls over the use of computer technology. To briefly re-call this moment in history, the Electronic Records; Electronic Signature (ERES) regulation, 21CFR11 or Part 11, was introduced to provide criteria whereby electronic records (e.g., database information) would be considered ‘equivalent’ to paper records. The underlying motivation was a concern that technology could potentially invalidate the truth claim of an utterance (e.g., ‘this drug is effective’) by ‘scrambling’ the context of the utterance and by potentially falsifying the name (attributability) and the date (auditability). But this regulation was based on a premise, which I will argue, was founded on a metaphysical blind spot derived both from an underestimation of the difficulties inherent in the reconstitution of events (historiography), on the one hand, as well as an overestimation of the nefarious impact of technology, on the other. As a consequence, it is no surprise that the Part 11 narrative fell prey to an onto-theology of the worse kind, and as a consequence never uncovered the true essence of technology.  相似文献

Despite high revalence rates of intimate partner violence in the lives of extremely poor women with depenent children, few studies have investigated the patterns of violence that occur over time, and the characteristics of women that serve as risk markers for partner violence. This study compared 43 adult parricides and 12 adolescent parricides. Several statistically significant differences were observed. Adults suffer from severe mental disorders, have a history of violent behavior and psychiatric antecedents, and are more likely to threaten their parents. Less predictable in their acting out, adolescents present several profiles as a function of victims’ sex, number of victims, diagnostic elements, and being witness to or victim of intrafamilial violence. Results suggest different approaches should be used to understand the dynamics and course of these two groups.  相似文献

This article examines the introduction of mediation in the French industrial relations context, as illustrated by the case of the SFR Cegetel collective agreement on social dialogue, which was signed in June 2002. This article provides an overview of relevant French legislation and explores why mediation is used so infrequently in France to settle labor conflicts, examines the growing interest in mediation in France as exemplified in the implementation of alternative dispute resolution (ADR) programs in several firms, and analyzes the barriers and incentives to mediation as well as the impact of internal mediation on the relations between management and employees.
We conclude that while inherited customs and lack of information curtail the use of mediation, disputants increasingly favor mediation as an option when they wish to gain time or when the situation is filled with especially acute open conflict. In addition, we conclude that the introduction of mediation favors a more participatory style of management, improves relationships between management and employees, and induces a better social dialogue within the firm.  相似文献

This work compares epidemiological and sociological data on persons having committed suicide in 2002 and in 2012 through a retrospective study of every suicide case having led to an autopsy at the Institute for Forensic Medicine of Lyon in 2002 and in 2012. The study included sociodemographic data, medical data, and toxicological data. A total of 486 cases were included (242 cases in 2002 and 244 cases in 2012). People committing suicide were on average older in 2012 than in 2002 with a larger proportion of over 55. There was also an increase in the proportion of psychiatric antecedents (p < 0.001). Whatever the date of death by suicide, the most affected age range is the 45–54. The results highlight the necessity of bolstering the prevention plans, in particular for people over 45.  相似文献
