Regime theory seeks to explain decisions by the Supreme Court of the United States by noting that justices tend to decide cases in ways that align with the prevailing political ideology. The theory emerged from political science literature and has not been explored regarding communication law. This article tests regime theory against the progression of seven Supreme Court precedents that led to the threatening speech test established in Brandenburg v. Ohio. The test is traditionally viewed as the fruit of about a half-century of deliberate judicial evolution. The analysis found regime theory helped explain the Court's progression and decisions in this line of cases, but contained some notable weaknesses. 相似文献
This paper explores notions of harm in sex work discourse, highlighting the extent to which essentialist ideas of ‘good’ versus ‘bad’ sex have pervaded trafficking policy. In a comparative examination of Australian Parliamentary Inquiries and United States congressional hearings leading to the establishment of anti-trafficking policy, we identify the stories that have influenced legislators, and established a narrative of trafficking heavily dependent upon assumptions of the inherent harm of sex work. This narrative constructs a hierarchy of victimisation, which denies alternative discourses of why women migrate for sex work. We argue that it is not sexual commerce that is harmful, but pathological, systemic inequalities and entrenched disadvantage that are harmful. A narrow narrative of trafficking fails to adequately depict this complexity of the trafficked experience. 相似文献
Self-communication platforms have generated a myriad of outlets and news producers that represent a challenge for modern societies. Therefore, it is relevant to explore new measurements that can help understand whether a specific outlet disseminating news could be considered reliable or not. This study is based on the expertise from the U.S. Intelligence Community to offer a statistical model that replicates the reliability measurements based on intelligence expertise. The results suggest that a classification algorithm could be useful to measure news media reliability. Intimate partner violence (IPV) rates have grown alongside the sweeping changes, challenges, and transitions necessitated by the onset of COVID-19. The goal of this exploratory study was to examine COVID-19 related risk markers for IPV perpetration. Data were collected from a national sample of 365 U.S. individuals who were in a relationship during August 2020, in the midst of the COVID-19 epidemic. Unadjusted odds ratios were calculated for 27 unique risk markers related to lifestyle changes due to COVID-19, mental health, isolation, financial impacts, and COVID-19 diagnoses. The strongest risk markers for IPV perpetration were feelings of loneliness, followed by anxiety symptoms, perceived stress, fear, boredom, substance use and lifestyle changes. Understanding risk markers associated with an increase in IPV perpetration can aid helping professionals identify individuals who may be at risk for IPV, or target these factors to aid in IPV prevention and intervention efforts.
This study compares provincial and territorial approaches re‐organizing the machinery of government to promote efficiency, innovation, and continuous improvement in legalizing recreational cannabis. Based on interviews with government officials from across Canada, our research assesses the effectiveness of various models, which ranged from officials‐level working groups and task teams to cabinet committees and formal secretariats. Findings reveal that, while governments took more integrated, network‐style approaches to policy development, modes of policy implementation and evaluation involved more conventional modes of hierarchy and market‐based organization. This shift will impact governments’ ability to execute and evaluate the legalization process. 相似文献
