This article presents some crucial and typical experiences of people who were erased from the Registry of Permanent Residents of the Republic of Slovenia in 1992. In the process of forming the new Slovenian state in 1991 (after the collapse of former Yugoslavia), the body of citizens was newly defined according to the principle of ius sanguinis. This means that ethnic Slovenians who until then were Yugoslav citizens automatically became Slovenian citizens. Permanent residents of Slovenia who ethnically originated in other republics of former Yugoslavia had to file an application to acquire Slovenian citizenship based on Article 40 of the Citizenship of the Republic of Slovenia Act. Approximately 0.9% of Slovenia's population (18,305 people) did not succeed in obtaining Slovenian citizenship because either they did not file an application or their application was rejected. These people were erased from the Registry of Permanent Residents by the Ministry of Internal Affairs on 26 February 1992. The Ministry carried out this secret erasure without any legal basis. The Aliens Act entered into force for the erased which then annulled all their previously acquired rights; legally and formally they were made equivalent to migrants who cross borders illegally. Thus, the people erased from the Registry of Permanent Residents were suddenly left without any rights: the right to a residence in Slovenia (in their homes with their families), the right to cross the state borders, and all other economic, social and political rights. The implementation of the erasure concerns the suspension of basic human rights, the annulment of the principles of a legal state and the production of redundant people. The author argues that the erasure from the Registry of Permanent Residents is constitutive of Slovenian citizenship: the erasure established certain power relations in society and a certain type of democracy.  相似文献

Few studies have examined the impact of intimate partner violence (IPV) within rural and northern communities. The current study addressed gaps within the literature by gathering perspectives from community service providers and academic researchers in order to increase understanding about the unique needs of IPV survivors within geographically diverse regions. Interviews were conducted with ten participants from Saskatchewan, Manitoba, Alberta, and Northwest Territories. Interviews focused on the unique needs of IPV survivors within each region, gaps that exist in meeting those needs, as well as questions pertaining to a larger research study entitled, Rural and Northern Community Response to Intimate Partner Violence. Results revealed several core themes relating to the unique challenges faced by IPV survivors within each region, as well as barriers to accessing services within rural and remote communities. Results also highlighted important considerations for future researchers, such as challenges that can arise when conducting research within geographically remote locations. Findings may help inform future development and implementation of services for IPV survivors residing in geographically diverse locations across Canada.  相似文献

The U.S. Courts of Appeals, working principally through three-judge panels, constitute important final arbiters of the meaning of the federal constitution, laws, and regulations and, hence, significant policymakers within the federal system. En banc rehearing—reconsideration of the decision of a three-judge panel by the full complement of judges appointed to the circuit—is an institutional device that ensures circuit decisions are in line with the established preferences of the circuit. The use of en banc varies in frequency across circuits and within circuits over time. Drawing on legal, attitudinal, and strategic perspectives of judicial behavior, we develop and test a set of integrated expectations regarding the causes of this variation. Our analysis finds support for the operation of all three models and suggests that the influence of ideology on the use of en banc in the recent era is not unique but part of a long-standing pattern .  相似文献

ABSTRACT

This article argues that the Western Balkans Counterterrorism Initiative (WBCTi), originally a Slovenian proposal of late 2014, represents an efficient form of regional security cooperation, particularly when regional EU integration is considered. The Initiative that was accepted by the Justice and Home Affairs Council of the EU in late 2015 is the first of its kind. It is aimed at both incorporating and integrating all forms of international assistance that concern increasing the capacity to prevent and combat terrorism, violent extremism, and radicalisation leading to terrorism. Additionally, it is directed at decreasing duplication of actions by international actors and raising levels of efficiency of security cooperation and reform. This article analyses the Initiative by focusing on its structure and claiming that its specific framework represents an innovative approach establishing a fully functional regional structure outlining EU-Western Balkans security cooperation.  相似文献

Signorino argues that the complex parametric relationshipsgenerated by even the simplest strategic models can lead towildly inaccurate inferences if one applies these traditionalapproaches. In their stead, Signorino proposes generating stochasticformal models, from which one can directly derive a maximumlikelihood estimator. We propose a simpler, alternative methodologyfor theoretically and empirically accounting for strategic behavior.In particular, we propose carefully and correctly deriving one'scomparative statics from one's formal model, whether it is stochasticor deterministic does not particularly matter, and using standardlogit or probit estimation techniques to test the predictions.We demonstrate that this approach performs almost identicallyto Signorino's more complex suggestion. A common problem in models for dichotomous dependent variablesis "separation," which occurs when one or more of a model'scovariates perfectly predict some binary outcome. Separationraises a particularly difficult set of issues, often forcingresearchers to choose between omitting clearly important covariatesand undertaking post–hoc data or estimation corrections.In this article I present a method for solving the separationproblem, based on a penalized likelihood correction to the standardbinomial GLM score function. After its initial success in the private sector, activity-based costing (ABC) has been embraced by the public sector as an analytical tool that can be used to improve the efficiency of government operations, especially in the area of the privatization of operations. Despite claims that ABC can greatly enhance the evaluation of how to most efficiently deliver services, there are significant obstacles that must be overcome before ABC can be effectively implemented. In order to underscore the challenges facing successful ABC execution in the public sector, the use of activity-based cost accounting by the City of Indianapolis for its privatization initiatives is discussed. Generally ABC is not up to challenge of providing local governments with the tool necessary to comprehensively evaluate direct services and determine which are candidates for contracting out or privatization.  相似文献
