After delimiting the topic by reflecting on the heuristic function of the concept of “theory” in “Delimiting the Topic” section, the paper considers the literary aspects of karman-theory in the Mahābhārata in “Literary Characteristics” section (treating questions, characters, episodes, tracts, metaphors, and intertextuality). “Axioms, Theorems, Domains” section then lists the elements or axioms that fall under the umbrella term “karman-theory.” Next, dealing with contexts and collocations, “Contexts, Collocations” section combines the consideration of literary and theoretical aspects of the matter. “Historical Perspective” section then argues for the inclusion of a historical perspective in the study of karman-theory. The use of paramilitary methods in civil policing tasks has become common in Western police agencies. Despite propositions that such methods should undermine the relationship between the police and the public, the effect of paramilitary policing on public trust in the police has not been empirically tested. In the present study, we examine this question in the context of protest policing, which has become a major concern for Western police agencies. Using a survey of 470 protesters who participated in “Occupy” protest events in Israel in 2012, we find that the perceived use of paramilitary methods has an independent and negative effect on trust, stronger than that of police effectiveness and the “neutrality” component of procedural justice. In‐depth interviews suggest that the significance of paramilitarism may be the result of a sense of alienation and criminalization it elicits among protesters who generally perceive themselves as law‐abiding citizens.  相似文献

Over the last 11 years, the Law Commission and the Scottish Law Commission have worked on a joint project to modernise the law of insurance contracts. Due to the size of the project, the Law Commissions proceeded in phases and separated out specific issues for legislative reform. Their proposals have already resulted in the Consumer Insurance (Disclosure and Representations) Act 2012 and the Insurance Act 2015 which brought about significant changes for consumer and non‐consumer insureds and insurers alike. This paper examines two further areas of reform: the introduction of an implied term about payment of insurance claims by insurers within a reasonable time and a statutory restatement of the doctrine of insurable interest. It considers the old and new substantive law and provides an insight into the reform process.  相似文献

A study was conducted to test whether it is possible to build a model to distinguish true and false allegations of rape based on the theory of fabricated rape. The theory is based on the principle that a false complainant of rape has not been raped and has to fabricate a story while the story of a true victim is based on recollections of the event. Consequently, false complainants will behave as liars do, construct their story based on their own sexual experiences and on mental representations, beliefs of how such a crime would happen (De Zutter et al. in Eur J Psychol Appl Leg Context. doi: 10.1016/j.ejpal.2016.02.002, 2016). To test the theory and to build a model to discriminate between true and false allegations of rape, a police sample of true and false allegations was studied. A total of 129, 72 true and 57 false, allegations of rape fulfilled the stringent criteria of the current study, among others on ground truth. Fifty-four allegations of rape, 27 true and 27 false, were used to build a prediction model based on the theory of bounded rationality by Gigerenzer (2002). The remaining 75 cases, 45 true and 30 false, were blindly categorised as either true or false based on the model. The model was able to predict the true nature of the majority of allegations with an accuracy rate of 91 %. Thus, it seems possible to discriminate to a considerable extend between true and false allegations of rape.  相似文献

Although the Sexual Violence Risk-20 (SVR-20) is widely used, its psychometric properties have only been investigated in a limited number of studies. This study explored the factor structure of the SVR-20 and examined its psychometric properties. Confirmatory factor analysis (CFA) was used to examine the fit of the original three-domain model of the SVR-20. The CFA showed that the original structure was not satisfactory. Exploratory principal components analysis (PCA) was conducted in search of a more optimal factor structure. Psychometric properties (i.e., internal consistency, predictive value, and convergent validity) of both the original domains and alternative factors were investigated. The PCA and subsequent CFAs pointed in the direction of an alternative, more optimal three-factor solution. The three alternative factors were labeled as Antisociality, Sexual deviance, and Problematic thinking and produced better internal consistency coefficients than the original domains. However, the validity of the SVR-20 was modest and no evidence was found indicating that the alternative factors were better in this regard as compared to the original domains. Despite the overall superiority of actuarial measures in predicting recidivism, the structured professional judgment of the SVR-20 proved to be more predictive of sexual, violent, and general recidivism than its actuarial scoring method.  相似文献

Racialized policing and substance use are major issues faced by African young people in Australia. In-depth interviews with 18 refugee young people who use alcohol and/or drugs examined interactions with police. Status respect and human respect played important roles in interactions with police. Participants felt unfairly targeted by police and reported that they were disrespected by police through the use of discriminatory language, failing to differentiate between individuals leading to a sense of loss of self-identity, and stereotyping. Development and implementation of programs focusing on building mutual understanding and respect is needed to improve relations between refugee-background youth and police.  相似文献
