Observation of tri-allelic patterns in autosomal STRs during routine casework

We report three cases of tri-allelic patterns observed during routine forensic casework on 5964 Belgian residents. These individuals had been typed for the following 15 autosomal STRs: CSF1PO, D3S1358, D5S818, D7S820, D8S1179, D13S317, D16S539, D18S51, D21S11, vWA, FGA, TH01, TPOX, D2S1338 and D19S433.The first example of a tri-allelic pattern had the genotype 13;15;16 for the D8S1179 locus. In the second observation there was 16;21;22 pattern for the D18S51 locus. The third case had the alleles 10;11;13 also for D18S51.All cases belonged to the Type I tri-allelic pattern, with three uneven peaks, the sum of the heights of both smaller peaks equalling the height of the tallest peak.Three cases in 5964 typed individuals is a frequency for tri-allelic patterns in autosomal STRs of 0.05%.     

The many lives of Bertha,Georges and Jean: a transgender mystic in interwar Belgium

ABSTRACT

This article addresses the religious career of a transgender mystic who died as Père Jean in 1967. While it might sound contradictory, for scholars working on women, mysticism and charisma, sources on Jean’s life offer exceptional insights. When Jean made the news in the 1920s, he headlined as Bertha Mrazek/Georges Marasco and was still perceived as a woman. Bertha’s cross-dressing, miraculous cure and law suit started discussions about what it meant to be a charismatic woman in post-war Belgium. Rather than focusing on the sensational aspects, the emphasis here is on Jean’s reinventions, the historicity of his appeal to others, and the importance of ideals of gender and sanctity as well as the historical context in the reception of this transgender mystic.     

Virtual reality: a use case for criminal justice practice

ABSTRACT

In recent years, virtual reality (VR) technology has convincingly demonstrated its potential for assessment, training, rehabilitation and treatment purposes in a variety of domains, including (mental) healthcare and education. This paper explores the possibilities for VR application within criminal justice practice. Criminological literature and literature of related disciplines on VR applications were reviewed with a special focus on risk assessment, correctional rehabilitation, and reintegration. We also devoted attention to the VR-based treatment of anxiety-related disorders among victims of crime. Literature shows that VR can provide safe learning environments that would otherwise involve risk, generate ethical and ecologically valid virtual alternatives for which real-life situations would be unethical to use, and develop environments that are impossible to create in the real life. These unique characteristics make VR a promising tool to expand the current toolbox of risk assessment instruments, and correctional rehabilitation and reintegration programs in important ways. Before implementing VR in criminal justice practice, an elementary understanding of both the advantages and disadvantages of VR technology is desirable but given a longstanding and effective VR tradition in other domains, the future of VR in criminal justice practice is bright.     

Local governments and their arm’s length bodies

ABSTRACT

In this paper, we discuss the state of the art on the creation of arm’s length bodies (ALBs) by local governments. We make three main contributions. First, there are many different types of ALBs and each country has its own categories; an expert survey was held identifying three common types of body, to enable future comparative research. Second, we point out that the creation of ALBs has led to a number of new challenges for local governments, particularly regarding governing bodies at arm’s length to ensure ALBs’ good performance. A lack of capacity and information have to be countered, for example, by increased monitoring – also for democratic accountability purposes. Special attention is needed for the multiple principal problem that arises when local governments jointly create ALBs. Third, research into local ALBs is still in its early stages. We present a research agenda to develop knowledge on the topic.     

Instituting Authority. Some Kelsenian Notes

A rule of recognition for a legal order L seems utterly circular if it refers to behaviour of “officials.” For it takes a rule of recognition to identify who, for L, counts as an official and who does not. I will argue that a Kelsenian account of legal authority can solve the aporia, provided that we accept a, perhaps unorthodox, re‐interpretation of Kelsen's norm theory and his idea of the Grundnorm. I submit that we should learn to see it as the vanishing point rather than the final basis of validity in a legal order. To prepare the ground for this proposal, I will briefly explore the claim to authority that is characteristic of politics. Then I sketch a multi‐layered canonical form of the legal norm, including their “empowering” character (Paulson) in terms of performative operators. I show how it leads to a “perspectival” account of the basic norm. In conclusion, I briefly point to the example of sovereignty and acquis communautair in international law to illustrate this view
