Why Do Regulatory Agencies Punish? The Impact of Political Principals,Agency Culture,and Transaction Costs in Predicting Environmental Criminal Prosecution Outcomes in the United States 下载免费PDF全文
Studies of administrative behavior are keen to examine the internal dynamics of agency decision making, as well the impact of external political actors on agency actions. Yet few studies apply these findings to the question of why agencies use their most punitive enforcement powers. Contrasting principal–agent, transaction costs, and organizational culture models of agency behavior, this study examines why regulatory agencies punish. Through content analysis of nearly one thousand of the U.S. Environmental Protection Agency's criminal investigations and subsequent prosecutions, 2001–11, findings suggest that punishment severity in environmental criminal cases is based less on transaction costs and political pressure and more on professional norms that value strong enforcement. These findings have important implications for explaining regulatory outcomes and administrative behavior. 相似文献

Law enforcement personnel (LEP) use a variety of tactics to perform their job duties. Although LEP often receive specialized training to work with ethnocultural minorities and are sometimes trained to work with lesbian, gay, bisexual, transgender, and queer (LGBTQ) citizens, a clear articulation of LGBTQ-affirming police tactics has not yet been established. Using qualitative content analysis and a multiple case study approach, this project identified a variety of tactics generated by LEP in written surveys and group discussion of scenarios involving LGBTQ citizens. Results showed that across all scenarios, LEP were able to generate LGBTQ-affirming tactics, including both typical police procedures, as well as approaches specific to LGBTQ citizens. Non LGBTQ-affirming tactics typically reflected reluctance to adapt general procedures to meet the needs of LGBTQ citizens. The results of this study support the use of group-based scenario training to help LEP identify and adopt LGBTQ-affirming approaches. International relations theories emphasize the stabilizing role hegemons play in world politics. But little scholarship has examined the link connecting hegemony to its potentially positive returns in the security realm: force posture. We correct this deficit by developing and testing an argument about the consequences of different hegemonic force postures under varying threat conditions. We present a typology of force posture options and probe their effects through over-time analysis of how major powers have worked to provide one particularly important public good since 1945: access to Persian Gulf oil. Drawing on field work, we also explore the implications of our framework for current and future US force posture in the region. We conclude that hegemonic stability is a very real phenomenon in the Gulf, but it does not require the massive forward deployment of US forces that has characterized the past twenty years of US presence there. 相似文献
