In October 2018, snack company Mondelez International, Inc. (Mondelez) filed an action against Zurich American Insurance Company (Zurich), requesting indemnification for more than USD $100,000,000 in losses caused by the NotPetya cyber virus. Zurich refuses to cover these damages alleging one of the insurance policy's exclusions for damage resulting from a hostile or warlike action by a government, as the NotPetya attack is said to have been sponsored by Russia. This case is noteworthy for multiple reasons: not only is it the first significant legal dispute in the insurance field concerning the recovery of costs resulting from a cyber attack, but it is also the first time that an insurance company is invoking the war exclusion to decline coverage for an allegedly state-sponsored cyber hack.This article analyzes the key issues of this important case, including attribution of a cyber attack to a State and interpretation of an insurance policy's war exclusion in a cyber context, and the likelihood of success of Mondelez's arguments. It also explores the strengths and limits of general principles of contract and public international law when applied to new technologies and cyber incidents. Finally, it discusses the potential impacts of the Mondelez case on the contents and limits of future traditional and cyber-specific insurance policies. 相似文献

The authoritative ( Novartis/transgenic plant systems ) interpretation of the Article 53(b) EPC exclusion from European patentability of plant and animal varieties, and essentially biological processes for the creation of plants and animals, is considered, and its significance for the trend of EPO jurisprudence and legitimacy of the EC Biotechnology Patenting Directive noted. The Enlarged Board of Appeal's justification for that interpretation in Novartis with reference to the exclusion's legislative history is challenged, and an alternative theory of that history proposed, based on a thorough analysis of the unpublished travaux préparatoires for the Strasbourg and European Patent Conventions. In addition to elucidating the framers' (actual and presumed) intent with respect to the Article 53(b) exclusion, that analysis offers an insight into post-war legal unification methodology and its continued impact on one of the most contentious and technical areas of intellectual property law. 相似文献

Unwelcome touching, groping, and kissing are illegal, but widely tolerated in public drinking settings. This contingency in the law's response means that patrons routinely negotiate the moral boundaries of nonconsensual sexual contact. We use 197 interviews with college‐age individuals to examine the discursive strategies young people employ when negotiating those boundaries. We find that most interviewees have experiences with sexual aggression, do not categorize it as aggression, but advocate for stronger legal punishments against offenders. In accounting for this paradox, they draw on contradictory legal and cultural narratives that both normalize and condemn men's sexual aggression. We build on legal consciousness theories and gender theories by highlighting the complex ways that gender stereotypes enshrined in law are implicated in the construction of a social problem. We also contribute to the sociology of culture by explicating the often unconscious link between culture and action revealed in young people's narratives about sexual aggression. 相似文献
