“见危不救”犯罪化的层次分析

社会对见危不救行为是否定的.对其价值判断的这种一致性,使得对其犯罪化不只是可能,而且是必要的.对见危不救行为动用刑罚加以调整,使人们自愿承担救人于危难间的义务,以促进社会的整体利益.我国刑法中应增加"见危不救罪",但要有严格的范围限制.     

经济刑事立法中存在的六个问题

<正>1.经济刑事立法不能与打击经济犯罪同步协调发展,缺乏适时性。随着新型经济关系的不断涌现,产生了与此相适应的各种新的经济犯罪现象和类型。如"官倒"、"法人犯罪"、"行业犯罪"、破坏国家资源方面的犯罪,污染食品、环境的犯罪,侵吞私营企业和承包经营企业财产的犯罪,破产诈欺、贷款诈欺、保险诈欺方面的犯罪,哄抬物价、坑害消费者利益方面的犯罪等。对这些新情况、新问题,刑法尚无明文规定。     

Attempts at drug control in Colombia,Peru and Bolivia

The paper analyzes as part of a broader study the drug-control policy of the cocacocaine producing countries of Colombia, Perú and Bolivia, beginning with a short introduction of the political framework. The legal and political emphasis of this policy lies in the area of control and repression, which therefore is analysed in more detail. One can recognize a (substantial) tendency towards overcriminalisation linked to easier (procedural) possibilities of criminal prosecution and punishment (II). However, this questionable policy, when examined from a civil rights standpoint, proves to be of limited efficacy: given the continuing flow of cocaine to the US and the expanding trade to Europe, the policy can hardly pass a qualitative test considering the quantitative evidence (III). There are basically two alternatives from the viewpoint of the producing countries: the international commercialisation of coca and alternative development; from the viewpoint of the consumer countries the controlled legalisation (IV).This article is based on criminological research about the drug policies of Colombia, Peru and Bolivia, which was accepted at the end of 1992 as a doctoral thesis by the Law Faculty of the University of Munich. Analyzing linked systems of negotiations

This article presents a conceptual framework for analyzing the structure and dynamics of what the authors call linked systems of negotiations. Even such seemingly straightforward transactions as the purchase of a family car tend to involve linked negotiations. The framework highlights the importance of internegotiation processes in shaping Zones of Possible Agreement, and proposes a typology of linkage. By mapping out and reengineering linked systems, negotiators can enhance their ability to shape the structure within which their negotiations take place.     

WTO体制下我国《商标法》的修改

2001年10月27日在我国加入WTO的前期,全国人大常委会对我国现行的《商标法》进行了一次全面的修改,不仅完善了我国的商标法律制度,同时也使我国知识产权法律规范更加符合WTO体制对知识产权保护的要求。本文对照分析Trips协议的规定和此次修改的内容,旨在说明此次《商标法》的修改与国际法律规则的成功接轨。     

论新世纪干部的“城市观”教育
