美国券商内幕交易行为的法律规制述评

券商内幕交易行为是内幕交易行为的一种,但因其所涉主体的特殊性而成为证券法研究的一个重要领域。从实体法角度而言,内幕交易作为一种证券欺诈行为殆无疑义,而券商从事内幕交易无疑也首先要从反欺诈的角度进行研究,其主要适用规则即著名的联邦10b-5反欺诈规则;从程序法角度而言,阻止券商从事内幕交易的关键在于中国墙的设置,这是一种设立于券商内部的信息隔离机制,也构成了券商豁免于反欺诈指控的抗辩。最后,对于传统上豁免于法律规制的券商证券分析活动,也因为存在卷入内幕交易的可能而在晚近被列为法律规制的对象,其主要的规制方法是程序性的,这不仅体现在相关法律法规中,而且也体现在一系列的行业自律规则和行业标准中。     

In situ Study on the Diffusion Kinetics of Seal Ink by Microinfrared Spectroscopy

In document examination, it is of great importance to determine the composition of seal ink with different imprint times, and spectroscopic methods are widely used today. In this research, the diffusion of seal inks from three different brands on the same type of paper is monitored in situ by microinfrared spectroscopy and microinfrared imaging technology. The area of the absorption peak at 1743 cm^?1 gradually decreases with increasing diffusion time. The diffusion kinetics of seal ink on paper are also studied by analyzing the infrared spectra of seal inks at the same measuring point with different diffusion times. The research provides a basic study in understanding the diffusion behavior of seal ink on paper over short time spans.

中国网络公共事件的议程互动模式——基于社会公平正义相关事件的经验研究

随着互联网技术的发展及网民队伍的不断壮大,网络议政和网络倒逼决策已然是当前我国互联网社会发展的重要特征。然而,透视近年来数十起网络公共事件可以发现,即便是在关乎社会公平正义的特定领域里,网络民意也不再局限于只对政府选定的政策议程进行讨论、监督和评价,而是不断借助网民集体行动和媒体的力量,在社会与政府的互动过程中确立新的政策议程,从而影响公共政策的制定。因此,客观且准确地描述并抽象出中国网络公共事件的议程互动模式以及理清该模式中主要环节的变化方式、作用及相互关系,对于提升网络时代中国政府决策的科学性、民主性和有效性以及维护社会稳定都具有积极意义。     

Predation enforcement options: an evaluation in a Cournot framework

The paper characterises the building blocks of a framework to enforce anti-predation rules and subsequently evaluates selected enforcement options in a Cournot-type duopoly predation model. Differentiating between a no rule approach, an ex ante approach and two ex post approaches, it is shown that an ex post approach typically maximises overall welfare. However, an ex ante approach can be the preferred option in cases where the entrant has a large cost advantage over the incumbent.     

非解乳糖链球菌FGM对大肠杆菌感染肉鸡肠道健康的影响

本试验旨在研究非解乳糖链球菌FGM对大肠杆菌感染肉鸡肠道健康的影响。选用150只1日龄白羽肉鸡,随机分为3组,每组50只,试验期21 d,饲喂基础日粮。1~10日龄时,空白对照组(BG)和模型组(EG)每只鸡每日灌服0.2 mL的生理盐水,非解乳糖链球菌(FGM)组每只鸡每日灌服0.2 mL浓度为1×10^9 CFU/mL的FGM菌液。FGM组和EG组鸡于14日龄时,灌服1次0.2 mL浓度为6×10^8 CFU/mL大肠杆菌O78菌液。分别于攻毒后第0、1、3和7天,观察各试验组鸡十二指肠肠绒毛结构,检测十二指肠sIgA含量、MPO、GSH-PX和SOD活力及T-AOC含量。结果显示,FGM组鸡十二指肠肠绒毛较EG组完整,MPO活力显著低于EG组(P<0.05),sIgA含量显著高于EG组(P<0.05),GSH-PX和SOD活力与T-AOC含量高于EG组。结果提示,分离于鸡盲肠的非解乳糖链球菌可通过保护肠绒毛结构、调节肠道免疫力与抗氧化能力,增强鸡抗感染力,发挥保护肠道健康的效果。     

"补供方"与"补需方"对医疗费用的影响比较 ——基于三明市新医改的实证研究

在医疗卫生体制改革中,"补供方"还是"补需方"的争论持续多年.这不但是决策者需要面对的重大政策问题,也是卫生经济学和医疗政策研究的重要理论问题.以福建省三明市为例,以公立医疗机构作为分析单位,研究地方财政对医院的补助、社会医疗保险的发展与医疗费用增长之间的关系.研究发现,财政补助占收入比重高的医疗机构的次均费用更可能低于财政补助比重低的机构;而医保的壮大与医疗机构费用增长之间没有显著关系."补供方"和"补需方"的选择意味着寻找政府管理和第三方机构经办的平衡点.就三明市而言,政府补助对于医疗机构费用控制的作用表明,通过"补供方"的经济杠杆效应控制医疗费用的过快增长仍有很大潜力",补供方"和"补需方"的平衡点需要进一步挖掘.     

From blues women to b-girls: performing badass femininity

This article introduces the concept of badass femininity, a marginalized femininity captured in the performances of contemporary b-girls (women breakdancers) and blues women of the 1920s. The author uses the work of Hortense Spillers, Maria Lugones, Chela Sandoval, and Angela Davis to argue that non-normative gender performances from the fringes of society are necessary consequence of histories of enslavement, genocide, and exploitation. Badass femininity is a one version of a multiplicity of femininities. It re-signifies qualities typically associated with masculinity through women whose work in dance and music move these gender performances from the margins to center stage.     

China’s Bargaining Strategies for a Peaceful Rise: Successes and Challenges

Applying bargaining theory of international conflicts, we examine the successes and challenges of China’s strategic choices in its ascent after the Cold War. We suggest that China needs to alleviate information and commitment problems in order to rise peacefully. Since 2008, China’s “peaceful rise” strategy has faced serious challenges because of its “assertive turn” in diplomacy. We argue that China has not alleviated or settled these two problems successfully because of its ambiguous “core interest” diplomacy and undecided attitude regarding multilateral institutions in resolving the maritime disputes. China should engage in rule-based, institution building, such as a security community between China and ASEAN, to reinforce its peaceful rise commitments.
