EU update     
This is the latest edition of Baker &; McKenzie's column on developments in EU law relating to IP, IT and telecommunications. This article summarises recent developments that are considered important for practitioners, students and academics in a wide range of information technology, e-commerce, telecommunications and intellectual property areas. It cannot be exhaustive but intends to address the important points. This is a hard copy reference guide, but links to outside web sites are included where possible. Posttraumatic stress disorder (PTSD) is arguably prone to malingering due to its subjective and heterogeneous nature. Various factors can influence PTSD symptom profiles including trauma type and trauma exposure. However, it is unknown whether trauma exposure influences malingered PTSD symptom profiles. We used a malingering simulation design with trauma type controlled to compare (1) PTSD symptom profiles (Posttraumatic Stress Checliklist-5; PCL-5) at the syndrome, symptom cluster, and individual symptom levels and (2) symptom validity profiles (Structured Inventory of Malingered Symptomatology; SIMS) at the overall and subscale level, as a function of direct and indirect trauma exposure. Seventy-three participants were randomly assigned to either the direct (“witnessed” trauma) or indirect (“learned about” trauma) condition. Participants were coached about symptoms and instructed to simulate PTSD. PCL-5 profile analyses revealed that simulators in the direct exposure group reported greater overall PTSD severity. Significant differences were found on cluster D (changes in cognition and mood) and individual symptoms including intrusive thoughts, amnesia, difficulty experiencing positive emotions, and risk-taking. No differences were identified for any other symptom scores nor for the symptom validity profile, except for the SIMS total score (direct: M?=?33.0, SD?=?12.8, indirect: M?=?26.5, SD?=?13.9, t(71)?=?2.06, p?=?.043, d?=?.48). These findings indicate that trauma exposure can influence malingered PTSD profiles at the syndrome, symptom cluster, and individual symptom levels (small effects), but, with one exception for a summary score, it does not produce a detectable difference on symptom validity testing. This study may provide insight for clinicians into the how malingered PTSD profiles can manifest as a result of direct and indirect trauma exposure; however, further research is strongly indicated.  相似文献

Although sanction threats promote fear, among committed offenders, that fear can become a resource with which to sculpt emerging crime preferences. In such cases, criminality is not deterred but channeled. We explore the channeling process here as it relates to auto theft and carjacking. Our qualitative findings reveal that auto thieves are reluctant to embrace the violence of carjacking due to concerns over sanction threat severity they attributed to carjacking—both formal (higher sentences) and informal (victim resistance and retaliation). Meanwhile, the carjackers are reticent to enact auto theft because of the more uncertain and putatively greater risk of being surprised by victims, a fear that appears to overcome the enhanced long-term formal penalty of taking a vehicle by force. We examine the implications of offenders’ decision-making for the analytic intersection of rational choice and deterrence, offering the notion of projective risk sensitivity to encapsulate the process.  相似文献

Migration is a common and essential livelihood strategy in the risk-prone environment of Sahelian West Africa. But migration is not a passive reaction to economic and environmental forces. Patterns of movement are determined by context-specific and complex dynamics, mediated by social networks, gender relations and household structures. IDS-based research on sustainable livelihoods illustrated this in two locations in Mali: in a village in the Sahelian dryland with different and gendered migration patterns of various ethnic groups; and exceptional patterns in the Sudano-Sahelian cotton region with extensive and long-lasting engagement in small cocoa and coffee plantations in Côte d'Ivoire.  相似文献
