Married Women Bankrupts in the Age of Coverture

Many married women with separate property held their property as stock-in-trade and traded independently from their husbands. However, if the business failed, a married woman trader's ability to take advantage of bankruptcy process depended on the exception to coverture according to which she held her separate property. This article is the first to examine reported bankruptcy cases involving married women in their doctrinal context and in relation to other exceptions to coverture. It analyzes the issues arising in the eighteenth century and argues that they should be understood in relation to the larger picture of married women's law, especially the law of private separation. The article also considers the oblique relationship between private separation jurisprudence and married women's bankruptcy in the nineteenth century, a relationship that was bridged by a line of cases that, on the surface, seem to be unrelated.     

The immigrant presence in collaborative structures of urban politics

Participation and representation of disadvantaged groups are important, but partly still understudied aspects of democratic politics. The present article looks at the inclusion of migrant representatives in urban governance networks making use of original survey data from 40 large cities in France and Germany. We find that about half of policy-relevant urban actors in both countries and across cities cooperate with migrant associations regularly. This indicates that urban governance networks are furthering the civic and political presence of migrants. Cooperation with migrant associations is more likely when specific representative local institutions (foreigner/integration councils) exist, and is also boosted by the overall density of governance networks in a city. Politicians and local administrators remain central actors in such networks, while social welfare organizations emerge as important interlocutors with migrant associations. The article identifies and discusses differences between the two countries.     

Cyber Security Responsibilization: An Evaluation of the Intervention Approaches Adopted by the Five Eyes Countries and China

Governments can intervene to a greater or lesser extent in managing the risks that citizens face. They can adopt a maximal intervention approach (e.g., COVID-19) or a hands-off approach (e.g., unemployment), effectively “responsibilizing” their citizens. To manage the cyber risk, governments publish cyber-related policies. This article examines the intervention stances the governments adopt in supporting individual citizens managing their personal cyber risk. The authors pinpoint the cyber-related responsibilities that several governments espouse, applying a “responsibilization” analysis. Those applying to citizens are identified, thereby revealing the governments' cyber-related intervention stances. The analysis reveals that most governments adopt a minimal cyber-related intervention stance in supporting their citizens. Given the increasing number of successful cyber attacks on individuals, it seems time for the consequences of this stance to be acknowledged and reconsidered. The authors argue that governments should support individual citizens more effectively in dealing with cyber threats.
