This article examines how institutional design leads state governments to win their cases before the U.S. Supreme Court. We analyze whether states are more likely to prevail on the merits when they create a formal solicitor general office and have an attorney from that office argue their cases before the Court. We employ an analytical matching approach and find that attorneys from state solicitor general offices are significantly more likely to win their cases compared to other kinds of state attorneys. Accordingly, if states prioritize victory before the Court, they should consider creating state solicitor general offices and granting those solicitors general the authority to control their appellate litigation.  相似文献

During the four decades before World War I, both the United States Army and the United States Navy underwent a massive transformation. What had been a frontier constabulary in 1880 became a world class army in 1918. What had been a hodgepodge of obsolete vessels in the 1880s emerged as a force second only to the Royal Navy during the same period. This paper examines the growth of transnational networks of innovation and proposes a preliminary classificatory system of four distinct kinds of forces which give rise to social networks that facilitate knowledge flows, relationship building, and collaborative activities important to accessing global markets. The networks may form around a technology sector, be identity based, emerge from a government-led initiative, or be stimulated by a civic or philanthropic organization. Each has a different mode of organizing, financing, and meeting its objectives, as shown by examples presented in the paper. The proposed classification of these characteristics is intended to open a conversation within the social sciences and among policy makers about how better to understand the ways in which transnational networks get formed, operate and produce desired results.  相似文献

This paper addresses the emergence of microcredit programmes as a preferred strategy for poverty alleviation world-wide. Taking the paradigmatic case of Nepal, it engages a genealogical approach to trace how Nepalese planners' enduring concerns about rural development intersect in surprising (and gendered) ways with donors' present focus on deepening financial markets. In the resulting microcredit model, the onus for rural lending is devolved from commercial banks to subsidized 'rural development banks' and women borrowers become the target of an aggressive 'selfhelp' approach to development. As a governmental strategy, microcredit thus constitutes social citizenship and women's needs in a manner consistent with neoliberalism. Drawing on ethnographic research, the paper also considers the progressive and regressive possibilities in the articulation of such constructed subjectivities with local cultural ideologies and social processes. Such an investigation can in turn provide a foundation for articulating a more normative agenda for development studies – grounded in the perspectives of those in subordinate social locations.  相似文献

ABSTRACT

How do public agencies respond when reform proposals threaten downsizing, reduction in functions, or termination? Agency survival during administrative reform is conventionally explained by structural characteristics, informed by the hardwiring thesis derived from the politics of the U.S. federal government. Parliamentary systems provide greater opportunity for agency reform, but there is little evidence of how agencies respond to such proposals or how proposals are altered prior to decision. We consider agencies as active participants in the reform processes, using strategic-relational theory to analyse their strategizing. The article employs detailed empirical evidence on 12 agencies subject to reform by the UK government between 2010 and 2013. We identify three archetypical defence strategies—technical expert, network node, and marginal adaptor—and argue that coding agency strategies alongside structural analysis can help better explain reform outcomes.  相似文献

Policy makers constantly face uncertainty, which makes achieving their goals problematic. To overcome this uncertainty, they employ tools to drive down uncertainty and make probabilistic decisions. We provide a method for scholars to assess empirically how actors make probabilistic predictions. We focus on the interactions between the executive and judicial branches, analyzing the conditions under which justices force the United States to provide them with information. Our approach generates substantive knowledge about interbranch behavior as well as a methodological innovation available to scholars who study political decision making under conditions of limited information.  相似文献
