Abstract Evictions and involuntary moves negatively affecting poor renters present a significant problem. Creating a national database to comprehensively document the magnitude of the problem, however, presents serious difficulties. Most local courts do not publish data on court actions involving evictions. To do this on a national level and to obtain all of the data needed by the authors would require special funding and the cooperation of courts; these are unlikely to materialize. To obtain comprehensive data on involuntary moves beyond the court system would present even greater difficulty. Improvements can be made in existing protections for tenants vulnerable to displacement without compiling comprehensive national data. Previous examples include the debates over displacement and homelessness. Since legislative and administrative reforms are more likely at the state and local levels, reform efforts, including any data collection, should be primarily focused there. 相似文献

The focus of this article is upon compassionate killings, that is, criminal cases where a parent/spouse has killed or assisted to die a child/spouse who was suffering from severe disabilities, debilitating injury, chronic or terminal illness. We argue that the partial defence of diminished responsibility, while appropriate for some cases, fails to acknowledge the compassionate and relational nature of these acts and thus fails to identify the quality of the harm committed. We also argue that the general defences of duress of circumstances and necessity, even if they were to be become available, are inappropriate. Developing the concept of ‘compassion’, which is a consideration in relation to prosecution for assisted suicide, we argue for the introduction of a partial defence of ‘compassionate killing’ which would reduce the offence from murder to manslaughter in recognition of the killing as a responsive, relational act of care. 相似文献

The numbers and types of all sexual offences examined at the Metropolitan Police Forensic Science Laboratory during the years 1978-1986 are presented. The largest number of sexual assaults took place during the month of August; they were mainly intra-racial and between adults of 18 to 30 years of age. A detailed breakdown is given of the offences against females recorded on the Sexual Assault Index. All these assaults were carried out by adult males, mainly strangers. Nearly half the assaults took place indoors, where victims were more likely to be bound and blindfolded, compared with one-third outdoors and one-sixth in vehicles. About one-fifth of the crimes were carried out by two men or more, and in one-third of cases, weapons were carried. Oral intercourse occurred in one-sixth and anal intercourse in one-twelfth of the offences, both performed more by white males and those of Mediterranean origin. 相似文献

In recent years there has been controversy surrounding the issues of the independence, responsibility and responsiveness of our public services. Critics come from two opposing directions: (i) there have been charges of politicisation of the public service, with the implication that it has lost its independence and become dominated by the government; (ii) Pusey (1991) has accused 'economic rationalists' in the public service of pursuing their own neo-classical agenda and dominating government policy. Both criticisms reveal a misunderstanding of the respective roles and responsibilities of ministers and public servants and the proper relations between them. In our system of democratic government, it is the prerogative of ministers to decide and the role of departments to propose and advise and then implement the decisions of ministers. This contribution begins by considering the respective responsibilities of ministers and officials, before canvassing the charges of politicisation and what should be expected from public servants in contributing to policy development.
