The present study examined relationships between reduction-in-force (RIF) personnel practices, presentation of statistical evidence, and litigation outcomes. Policy capturing methods were utilized to analyze the components of 115 federal district court opinions involving age discrimination disparate treatment allegations and organizational downsizing. Univariate analyses revealed meaningful links between RIF personnel practices, use of statistical evidence, and judicial verdict. The defendant organization was awarded summary judgment in 73% of the claims included in the study. Judicial decisions in favor of the defendant organization were found to be significantly related to such variables as formal performance appraisal systems, termination decision review within the organization, methods of employee assessment and selection for termination, and the presence of a concrete layoff policy. The use of statistical evidence in ADEA disparate treatment litigation was investigated and found to be a potentially persuasive type of indirect evidence. Legal, personnel, and evidentiary ramifications are reviewed, and a framework of downsizing mechanics emphasizing legal defensibility is presented.  相似文献

Summary The 1967 Task Force Report on Organized Crime (TFR) found that “...all available data indicate that organized crime flourishes only where it has corrupted public officials.” 48 From that standpoint, neutralizing local law enforcement would appear to be central to criminal operations. That conclusion would depend on (a) how one defines “organized crime” and (b) the assumption that organized crime described by the Task Force covers all cases and species of it including what is referred to as “non-traditional” organized crime. A conclusion that seems unchallengeable in the Report is the observation that it was impossible to determine “the extent of the corruption of public officials in the United States.” The lack of information on this question was aggravated by the fact that many of those who provided information to the Task Force were themselves public officials.  相似文献

This paper examines variations in firm-level adoption of environmental management systems (EMS) – ISO 14001 and the European Union's Eco-Audit and Management Scheme (EMAS) – in the United Kingdom, Germany and the United States. Drawing on insights from club theory, institutional theory, and stakeholder theory, it argues that despite the fact that these EMS are created by supranational organizations (one regional and one international), firms' perceptions of their costs and benefits are largely determined by domestic factors. In particular, these perceptions are shaped by how EMS are promoted and information about them is disseminated in each country (supply aspects) and how the constellation of stakeholders (suppliers, environmental groups, regulators, general public) support their introduction (demand aspects). The paper concludes that there are numerous ways governments and interested stakeholders can encourage companies to adopt voluntary environmental codes. The key is to find the right mix of incentives for specific national contexts.  相似文献
