In this paper, we show that current statistical measures of legislator's shirking are implicitly based on the electoral concept of a unique majority rule equilibrium point in the policy space where elections are contested. We note that such equilibria do not exist generically and present statistical results showing that cross-sectional regressions where legislators' voting indices are predicted by district average demograhic and economic data are mis-specified. We also discuss a weaker equilibrium construct, the uncovered set, and present statistical evidence showing that differences in voting behavior between Senators from the same state are positively related to the heterogeneity of the electorate. We argue that current evidence alleged to show shirking by Senators is equally consistent with Senators who perfectly represent an idiosyncratic constituency that cannot be represented by district average data.  相似文献

It is well known that competent patients must be told about the risks of proposed medical procedures. This paper argues that recent professional guidelines and the law of negligence now take matters further by requiring doctors to take reasonable steps in an attempt to ensure that patients understand the risks they are being invited to run, so facilitating meaningful choices and the opportunity to give a properly informed consent.  相似文献

Drawing from the inequality and crime, racial invariance, and Latino paradox literatures, the effects of inequality on youth reoffending are examined. Specifically, hierarchical logistic regression models are estimated to determine: (1) whether racial and ethnic inequality have similar contextual effects on the continued delinquent behavior of at-risk youth and (2) whether these effects are specific to black or Latino/a youth residing in Maricopa County, Arizona (N = 13,138). Findings suggest that racial inequality increases reoffending while ethnic inequality decreases reoffending. Additionally, Latino/a youth are less likely to reoffend in areas characterized by high income and racial inequality. Structural theories of crime should continue to account for the importance of culture and the resilient responses employed by Latinos/as living in criminogenic environments.  相似文献

Recent criminological scholarship on penal history museums has shown how sites of popular culture tend to silence the voices of prisoners and present them in ways that legitimate the deprivation of their liberty. While representations that reinforce the penal status quo are observable at most Canadian penal history sites, there are outliers that situate imprisonment as a form of oppression, and account for prisoners’ struggles and resistance. Drawing on three case studies from a 5-year qualitative research project on Canadian lock-up, jail, prison and penitentiary museums, we discuss what critical punishment memorialization looks like in a context of penal intensification in Canada. We show how such critical representations depend on the historical contextualization of penality as a manifestation of colonialism and/or the incorporation of prisoners’ voices and standpoint. We argue that the critical representations and narratives at these museum sites open up possibilities for the social distance between penal spectators and the incarcerated to be diminished by bringing humanizing prisoner narratives into focus in an otherwise dark tourist space.  相似文献

Recently, DeLisi and Vaughn articulated a temperament-based theory of antisocial behavior which they expressed as the first within criminology to use temperament explicitly, and as the exclusive explanatory construct of both antisocial behavior and negative interactions with the criminal justice system. We provide an initial empirical test of the theory’s two main constructs of effortful control (EC) and negative emotionality (NE) with respect to juvenile offending using a sample of 27,712 adjudicated youth. Cox regressions reveal youth with lower levels of EC and those with higher NE re-offend faster, controlling for demographics plus many prominent risk factors. Furthermore, the approximately 5% of youth at the extreme ends of both low EC and high NE evidence higher recidivism rates and faster time to failure. The findings show strong initial support for temperament theory, and we discuss relevancy for future research, prevention and intervention.  相似文献

Since their inception in 1992, the number of charter schools has grown to more than 6,800 nationally, serving nearly three million students. Various studies have examined charter schools’ impacts on test scores, and a few have begun to examine longer‐term outcomes including graduation and college attendance. This paper is the first to estimate charter schools’ effects on earnings in adulthood, alongside effects on educational attainment. Using data from Florida, we first confirm previous research (Booker et al., 2011 ) that students attending charter high schools are more likely to graduate from high school and enroll in college. We then examine two longer‐term outcomes not previously studied in research on charter schools—college persistence and earnings. We find that students attending charter high schools are more likely to persist in college, and that in their mid‐20s they experience higher earnings.  相似文献

This paper examines both the direct and indirect effects of images of corporate social performance on internal stakeholders. The authors suggest that public affairs managers must be particularly concerned about the ways in which images that are intended for and projected at external stakeholders are reflected back to internal stakeholders. In this new era of extremely tight labour markets, minimal corporate loyalty and high job mobility, public affairs efforts will increasingly impact upon a firm's employees. By monitoring this process, managers may more quickly identify the moment when internal stakeholders have developed a perception that differs from their original intent. This will allow managers to make a better job of maintaining a consistent image of the firm both inside and outside, and of managing the culture of the firm and its key human resources.
