Recall from informed consent counselling for cataract surgery

The authors investigated the effect of giving written material on information recall from informed consent counselling for cataract surgery. Fifty English-speaking patients who underwent non-urgent cataract extraction at Flinders Medical Centre, South Australia, were prospectively enrolled. Systematic counselling for cataract surgery was provided, with a written copy of the content given to a randomly selected group of patients (n = 24). All subjects completed a questionnaire after counselling and again at two weeks after surgery to test their satisfaction with, and recall of, information provided. Patients were found to be satisfied with the amount of information they received and most were able to recall details about the cataract surgery procedure. However, many could not recall success rates or complication rates and only a minority could list any complication. The provision of written information did not significantly alter recall (p>0.05). Recall was significantly better immediately after counselling than two weeks after surgery (p<0.05). Younger patients also had significantly better recall (p<0.05). Patients were happy with the information they had been given but did not remember enough from the informed consent process to satisfy legal requirements.     

Paolo Zacchia--the spiritual father of forensic medicine

Paolo Zacchia (1584-1659) was the personal physician of the popes Innocent X and Alexander VII, legal advisor to the Rota Romana and head of the health system in the Papal States. His most important work, written in Latin, is entitled "Quaestiones Medico-Legales" and was published in 9 volumes between 1621 and 1651. Even after Zacchia's death comprehensive reprints were published at several places up to the late 18th century. Zacchia covered all the medicolegal issues of his time including the problem of "malpractice" and medical ethics. He is rightly considered an outstanding representative of his profession, whose "Quaestiones Medico-Legales" gave legal medicine its name.     

Misappropriation of Institutions: Some Lessons from the Environmental Dimension of the NAFTA Investor-State Dispute Settlement Process

Trade regimes at all levels have confronted the dual challenge of rapidly expanding foreign direct investment, and the vigorous growth of international environmental regimes. Attempts to develop a global investment regime have encountered resistance, not least from environmental interests. At the same time, regional trade regimes have sought to address both the environmental and the investment agenda but in a very different manner. This article looks at problems encountered with the investor-state dispute settlement process established by the North American Free Trade Agreement (NAFTA). The institutional dimension of this process is largely drawn from the General Agreement on Tariffs and Trade (GATT), and existing international institutions for commercial arbitration. The article traces some of the difficulties encountered in attempting to use institutions designed for a specific purpose and implemented in one organizational context, to achieve a different purpose in another organizational context. It discusses the problems that arise when institutions appropriate for settling commercial disputes between private actors are used as the basis for balancing private interests and public goods, the environment in particular. It highlights the importance of a more developed understanding of the interplay between institutions and organizations at the international level so as to avoid undesired outcomes.     

The Catholic Church in Poland on Muslims and Islam

ABSTRACT

The politicization of the increased influx of migrants to Europe in recent years, as well as Islamist terrorist attacks carried out in European cities, have led to a situation in which anti-Muslim sentiments have reached unprecedented levels. It is not only those European countries directly affected by the growth of the Muslim population that register increased generalized negative feelings towards that population, but also those that are home to very small and partially autochthonous Muslim populations, like Poland, which has not served as a transit point or a destination for the increased number of people arriving from Syria and elsewhere to claim asylum in Europe. P?dziwiatr’s article explores the ambiguity of attitudes in the Polish Catholic Church towards Muslims and Islam in these new circumstances. It examines both the Church’s official statements and the opinions of students in Catholic seminaries, which diverge significantly. When the positions of some of these present and future priests are communicated to the public, they contribute to a strengthening of hegemonic representations of Muslims as Others, rather than a deconstruction of them.     

Information alliances in contests with budget limits

We study the role of information exchange that may occur in alliances in a contest without noise. Contestants learn their own limits of what they can spend in a contest. They may also form alliances and learn the limits of all players who are within the same alliance. Then they decide independently about their own contest efforts. Alliance formation for the purpose of information exchange is beneficial for members of the same alliance and neutral for all other players. Also, a merger between alliances is beneficial for their members. Further, we identify and discuss the set of stable alliance combinations.

Es stellen sich ganz konkrete Fragen der Sprach- und Rechtskenntnis ebenso wie theoretische Herausforderungen der demokratischen Legitimation. Im Zentrum der Analyse stehen das Legalit?tsprinzip und die damit verbundene Notwendigkeit der gesetzlichen Determinierung transnationalen Polizeihandelns in ?sterreich.
