The effect of jury deliberation on jurors' reasoning skill in a murder trial was examined. Specifically, the effect of deliberating on reasoning competence (as defined by Kuhn, Weinstock and Flaton, 1994) was explored. One hundred and four participants viewed a videotaped murder trial and either deliberated in 12-person juries or ruminated on the case individually. Among those assigned to juries, half had their reasoning skill assessed prior to deliberations, while the others were tested after deliberating. Jurors in the individual rumination condition were assessed after they had the opportunity to reflect on the case alone. As hypothesized, post-group-deliberation jurors were more likely to discount both the selected verdict and alternative theories and incorporate judgmental supporting statements than were the other mock jurors. However, the mock jurors did not differ with regard to making statements that supported alternative verdicts or including judgmental statements that discounted their chosen verdict. In terms of Kuhn's reasoning continuum from satisficing (low level) to theory–evidence coordination (high level), there is some evidence that post-group-deliberation jurors may be closer to the high end than predeliberation jurors or post-individual-rumination jurors in some aspects of the task, but not in others.  相似文献

Adolescence is perhaps the most difficult period of child rearing for parents. This study attempted to identify disciplinary techniques used by parents as perceived by mothers, fathers, and their adolescent children. Results indicated several significant areas of intrafamilial disagreement in regard to disciplinary techniques utilized, although all subjects tended to agree that some form of verbal reasoning was the primary disciplinary technique utilized with these adolescents.This study was funded, in part, by the Ohio Agricultural Research and Development Center (H-644) and the School of Home Economics, The University of Georgia.Received his Ph.D. in child and family studies from the University of Tennessee. This study examined the relationship of identity status to ego development and locus of control in 75 college women. The identity statuses did not differ significantly in self-reported locus of control, but did differ on the depth measure of ego development. Consistent with identity theory and with previous research with males, identity achievers and moratorium (incrisis) women were more advanced in their ego development than fore-closure and diffusion women.This article is based in part on the doctoral dissertation of Sheila D. A new 40-item behavioral checklist, the Adolescent Life Assessment Checklist (ALAC), was devised to be used with patient and nonpatient samples. A comparable form obtains information from a parent or guardian. Responses of 356 adolescents from three sources were analyzed for differences attributable to race, sex, age, sample source, and their interactions. A factor analysis was carried out on the average within-race-sex-source subgroup correlation matrix, resulting in seven meaningful and six usable oblique factors. Subscales were developed and corrections were computed to remove estimated differences due to race, sex, and age. This study was an attempt to isolate and identify some important variables related to conservation knowledge and interest in high school age youth. The major goal of this study was to establish some basic variable groups that could provide additional meaning and direction for reintroducing an integrated conservation program into the secondary school curriculum through a more appealing instructional approach. Findings indicated that the assumption of a direct relationship between knowledge and interest does not necessarily hold. Findings also contradict popular assumptions regarding rural-urban, male-female, and age differences in levels of conservation knowledge and interest. Open-ended program approaches based on the variables identified could lead to improved methods for increasing conservation knowledge and interest.Received his M.S. in forestry from Virginia Polytechnic Institute and State University. 量刑建议是检察机关在指控犯罪时就被告人应当判处的刑罚向人民法院提出的意见.量刑建议权本质上属于公诉权,同时,量刑建议也是检察机关履行审判监督职能的有效方式.检察机关提出量刑建议,有利于促进量刑公开、公正,保障司法公正,提高诉讼效率,加强审判监督,提高公诉人素质.从目前检察机关探索量刑建议的情况看,各地做法并不统一,因此,需要明确量刑建议的原则、适用范围、提出时机和形式、方法、内部审批和变更程序以及量刑问题的法庭审理程序等问题.  相似文献

Starting from the position that it is necessary to have some model of the learning process, if legal education is going to respond to pressures for change in a useful way, the article introduces John Dewey and his model of learning. It identifies shared concerns and techniques that informed Dewey's understanding of the learning process and that inform legal processes. Traditional and clinical approaches to legal education are mapped against the model of learning supplied by Dewey, with the hope of providing an intermediate level linkage between his learning theory and the task of curriculum design in legal education at institutions of Higher Education in the UK.  相似文献
