论环境责任保险对侵权法之影响

侵权法的局限性催生了环境责任保险,而传统侵权理论对环境责任保险正当性的质疑是站不住脚的,它阻碍了环境责任保险的发展.事实上,环境责任保险制度把环境民事责任与合同契约责任有机联系起来,弥补了侵权行为法在环境侵权领域的局限性,适应了时代发展的要求,不仅不违反道德规范,不会导致个人责任没落,反而突破了传统侵权理论的桎梏,强化了侵权法的补偿功能,促进了无过错责任原则的发展,扩大了侵权责任的范围和领域,有助于近代侵权法向现代侵权法过渡,对侵权行为法具有积极影响.     

对社区侵财型案件多发现象的分析

城市社区侵财型案件呈现出多发态势,成为影响社会治安秩序的一个突出问题。导致此类案件多发的原因主要包括社会原因、群众自身防范能力不足以及公安机关在实施社区警务战略方面存在着一定问题等。公安机关只有发挥主观能动性,通过提高群众的防范意识、转变打防观念、创新警务模式等措施,才能最大限度地减少社区侵财型案件的发生。     

Determining Line-Crossing Sequences Between Laser Printing and Writing Pen Using Coaxial Light

Determining the application sequence of hand-written pen ink and printer toner lines has attracted significant interest in questioned document examination. This study uses coaxial light to determine line-crossing sequences, with intersections observed under a VSC600 forensic document workstation and a Leica M205A Stereo-microscope. Results show that reflected light at intersections and color contrast between intersections and nonintersections was observed when a hand-written ink line passes over a toner line, while a toner line passing over a written line appeared dull, with no color contrast. The procedure was tested under a range of conditions, such as types of writing pens and laser printers, the writer, and writing pressure, with the latter playing an important role in the evaluation. To validate the results, a 90% detection rate and 98% accuracy rate were achieved from 50 samples of blind testing, which is more effective than optical microscopy.     

低水平工资下的长时间劳动 —— 基于富士康的考察

本文利用富士康公司及政府部门公开数据,对富士康员工工资水平进行了分析,认为富士康员工"自愿"进行的过度劳动,是在低工资支付方式与半军事化管理模式的双重作用下劳动者的一种必然的行为选择,并对这种长时间劳动供给行为的影响进行了考察。本文亦指出,在经济增长的不同阶段,地方政府的目标指向和公共政策的理念也在发生变化,因而"富士康"式的企业发展模式从被接受到被质疑的转变是不可避免的。     

Saving Strong Neighborhoods From the Destruction of Mortgage Foreclosures: The Impact of Community-Based Efforts in Detroit,Michigan

Mortgage foreclosures hit Detroit, Michigan hard between 2005 and 2014, especially in what we define as strong neighborhoods; there, more than one third of homes experienced foreclosure. Before the crisis hit, these selected tracts had largely intact physical environments and higher owner occupancy, household income and property value than the citywide median. In some of them residents worked intensely to abate the neighborhood effects of mortgage foreclosures. This study examines those efforts’ effectiveness. We selected neighborhoods with the most extensive efforts, as measured, for instance, by creation of community-based plans and applications for grants, and we conducted interviews and field observations to examine those efforts. To assess strengthening of neighborhood housing markets, we applied a modified adjusted interrupted time-series approach to evaluate changes in prices as one measure of neighborhood change. We found that strong resident initiative supported by community development organizations and external assistance led to increased neighborhood housing prices, compared with comparable neighborhoods. However, when initiative, context, and support were weaker, community-based efforts could not prevent considerable decline.

生育保护假期制度是保障育龄妇女权益的重要手段,OECD国家将产假期限、工作保护和津贴补助三者有机结合,创设的陪产假和育婴假制度极大地促进了性别平等,帮助受雇者平衡工作与家庭的冲突,提升了生育保护水平。当前中国面临着二孩政策全面放开后生育率不如预期乐观的情况,如何走出低生育率陷阱成为亟需解决的问题。通过对OECD国家和中国现有的产假制度进行比较,研究为完善我国生育产假政策提供建议。     

Activists playing a dual role: identities,organizational goals,and public relations practices

• This study explores the relationship among identities, goals, and public relations practices of an activist organization through in‐depth interviews and document analysis. Findings suggest different levels of the participant organization's identity in communication with its different audiences. In playing its dual role (as a “public” to its target organizations and a “public communicator” to its own publics), the organization acts as an honest representative voice and a credible source of information to both parties, a process that requires a balance position compatible with its mission. Its public relations practices were found to be consistent with the identities it appropriates and the values it respects.

关于国际汉学中“误读”的思考

国际汉学中的"误读"是外国汉学家接触中国文化时不可避免的。"误读"作为一个批评术语,它的出现明显受到了20世纪西方科学主义与人本主义哲学思潮及相关文论的影响。"误读"理论为我们正确对待汉学家的"误读"提供了可借鉴的方法论意义:汉学家研究中国、"误读"中国的根本目的是要借对汉学的研究审视自身;同时,其他民族对中国的研究也不妨成为我们自识的"镜像"。     

北京及周边地区乳牛乳腺炎的调查与病原菌分离鉴定

为了解乳牛乳腺炎的发病原因,对北京及其周边地区4个奶牛场的乳牛乳腺炎的发病情况进行了临床调查、诊断和检测,采集患临床型乳腺炎和隐性乳腺炎乳牛的乳样;用接种法对采集乳样进行培养,对可疑菌落进行分离、接种、染色、镜检鉴定.结果显示,从采集的266份乳样中分离到7种434株病原菌,其中葡萄球菌150株,链球菌204株,革兰阴性杆菌80株.证实,北京及其周边地区乳牛乳腺炎的主要病原菌为葡萄球菌和链球菌,且细菌混合感染引起的乳牛乳腺炎有上升趋势.

党的十八大报告中首次提出"建设学习型、服务型、创新型的马克思主义执政党",而且将这个党的建设总目标写入了新修改的党章。从党的建设总目标的历史探索轨迹和党的建设总布局的形成发展轨迹看,从对执政党建设的理论意义和现实意义看,要把中国共产党建设成为学习型、服务型、创新型的马克思主义执政党确实是一项全新的重大课题。"学习型、服务型、创新型"既是一个系统的价值整体,同时,在这个系统中,又必须凸显全心全意为人民服务的根本宗旨,紧紧围绕改进服务方式、提高服务质量来加强学习、开拓创新,惟其如此,才能真正体现马克思主义执政党作为实现、维护和发展人民群众利益的工具的本质。
