对盗窃信用卡并使用行为的定性

我国《刑法》第一百九十六条第三款规定:盗窃信用卡并使用的,以盗窃罪论处。该款规定并不妥当,因为盗窃信用卡并使用的行为可能触犯盗窃罪、信用卡诈骗罪或诈骗罪。故应予以删除。

七十年前,曾有这样一群人,他们怀着坚定的理想与信念,征服了人迹罕至、鸟兽绝临的雪山蛮野,粉碎了力量数十倍于己的反动势力的围追堵截,创下了一个人类历史上的伟大壮举——长征。今天,为纪念红军长征胜利七十周年,本刊将陆续发表以长征亲历者为主的回忆、纪念文章,以志怀想。本期所编发的几篇回忆文章原刊载于上世纪90年代初沈阳军区内部编印的《革命回忆录汇集》,其中既有对“左”倾机会主义者给中国革命造成严重危害致使红军被迫长征的憎恶鞭挞,也有对工农红军在艰苦卓绝的伟大长征中不惧艰险勇往直前的讴歌赞美。这些长征亲历者如今都已不在人世,但通过他们的口述,却给我们后人留下了那个艰苦岁月的永恒印痕,留下了一笔笔宝贵的精神财富,其中不乏对我们今人的启示与鼓舞。     

PPMs标准研究

环境污染很大程度上是在生产过程中产生的,PPMs标准就是对产品的加工和生产过程所制定的特定的环境标准。PPMs标准作为国际环境保护的一个重要措施,同时又成为影响WTO规则下自由贸易的一种壁垒方式,日益成为国际社会关注的重点。本文在对WTO法规内外PPMs标准研究的基础上,提出了对PPMs标准需客观地看待的观点,并对我国应当采取的法律对策提出粗浅建议。

检察机关应从解决公民控告申诉检举问题入手,对行政违法失职行为进行监督,促进依法行政,从根本上解决信访难题,以维护社会稳定,促进和谐社会建设.同时形成检察机关对司法、行政执法活动监督的格局,完善检察机关的法律监督体系.     

Long-term consequences of being placed in disciplinary segregation†

Being placed in restrictive housing is considered one of the most devastating experiences a human can endure, yet a scant amount of research has been conducted to test how this experience affects core indicators of prisoner reentry such as employment and recidivism. In this article, we use Danish registry data, which allow for us to link penal conditions to postrelease outcomes, to show how the reentry outcomes of individuals placed in disciplinary segregation, which is placement in restrictive housing because of disciplinary infractions, compare with those sanctioned for in-prison offenses but not placed in segregation. The results from matched difference-in-differences analyses show that Danish inmates placed in disciplinary segregation experience larger drops in employment and larger increases in the risk of being convicted of a new crime in the 3 years after release from a correctional facility than do Danish inmates who were sanctioned for a serious offense but not placed in disciplinary segregation as a result. Because being placed in disciplinary segregation, and restrictive housing more broadly, is so common, these results indicate that restrictive housing placement may be a key moderator of the effects of incarceration that merits more attention from criminologists, provided the associations shown here represent causal effects and generalize.     

台湾地区公诉权制约机制及其借鉴意义

近年来台湾地区的刑事诉讼经历了重大的改革,其公诉权制约机制较为完善。对于检察官不起诉、缓起诉处分,立法设置了再议制、交付审判制进行监督和制约,防止检察官滥用不起诉权;对于检察机关的起诉则在审前以起诉审查制进行制约,防止未达起诉法定门槛的案件进入审判。对于大陆来说,其公诉权制约机制有很大的借鉴意义。大陆也应设立公诉权的司法权制约机制,对于检察机关的起诉和不起诉都应最终由法院来进行审查和制约,以保证公诉权合法行使。但对于台湾地区公诉权制约机制的不足之处,借鉴的同时需予以改进。     

国内外青年志愿者工作机制比较研究

我国青年志愿者活动在近几年特别是2008年的北京"奥运会" "残奥会"期间有了极大的发展,但相比较于国外发达国家仍存在很大差距.笔者就国内外的青年志愿者活动组织机制、培训机制、评估机制、激励机制、保障机制等方面进行比较分析,希望对我国青年志愿者活动的发展提供理论和实践意义的帮助.     

A health management research on the insured group who participate in medical insurance

Taking the insured group who participate in medical insurance as the main subject, Wendeng city carries out the health management and establishes health files for the insured. Through the free health checkup for the high-risk group, the targeted health interventions are conducted according to the physical examination results of those people, and relative health education has achieved satisfying effects. The health education in different western countries has been carried out for more than 20 years, which accumulates a wealth of experiences. However, health education in China has not yet gained sufficient attentions, and to develop the domestic health education becomes an imperative task at present.     

加强公安队伍职业化建设的几点思考

公安队伍职业化建设是公安工作走向现代化、社会化的一个必然变迁过程和形态,具有相对严格的构成要素。推进公安队伍职业化建设,必须大力加强政治建警,理顺组织管理体制,健全教育培训机制,优化监督惩戒机制,推进公共关系建设。
