Designing Ethical Online Dispute Resolution Systems: The Rise of the Fourth Party

As the pandemic forces public and private institutions to move online, many court and business leaders are looking to the field of online dispute resolution (ODR) for best practices and lessons learned. Developed over the last twenty years, largely in response to the growth of e‐commerce, the ODR field has generated a deep well of theory and practice while also identifying potential ethical dilemmas and risks. The application of technology, the “fourth party,” plays an increasingly integral role in how we negotiate resolutions to our disputes, with or without a third party. A brief overview of the history of ODR’s development will set the context for the exploration of the range of tools and techniques encompassed by online dispute resolution. Consideration of the ethical challenges raised by ODR practice will illuminate key questions and choices that need to be made in designing ODR systems and in governing their use.     

Sexual fantasies and sensation seeking among psychopathic sexual offenders

Abstract

This study investigated the relationship between psychopathy, sensation seeking behavior and sexual fantasies in a sample of 199 participants from a maximum security forensic hospital. Psychopathy, measured by the Psychopathy Checklist – Revised (PCL-R), and several sensation seeking and sexual fantasy measures were utilized. Results indicated that, in agreement with previous research, sexually deviant psychopaths are more likely to offend against adults than children. Likewise, psychopaths showed some tendency to score significantly higher on sexual sensation seeking measures than nonpsychopathic sexual offenders. Furthermore, a relationship between psychopathy and overall sexual fantasies existed but there were not specific patterns among psychopaths and nonpsychopaths with regard to specific categories of sexual fantasies.     

Evidence of a gene x environment interaction in the creation of victimization: results from a longitudinal sample of adolescents

A large body of research has revealed that aggressive personality traits and violent criminal behaviors are influenced by genetic factors. Surprisingly, however, no research has been devoted to investigating the potential genetic origins to adolescent victimization. In the current study, the authors address this gap in the literature by using data from the National Longitudinal Study of Adolescent Health (Add Health) to examine whether different variants of the dopamine D2 receptor gene (DRD2) are related to victimization, net of the effects of environmental measures. The results of the multivariate models revealed a significant gene X environment interaction in the creation of victimization for White males. Specifically, DRD2 interacted with delinquent peers to predict victimization. The authors discuss the implications of these findings.     

Divorce, Custody, and Spousal Violence: A Random Sample of Circuit Court Docket Records

The fastest growing marital status category in America is divorced, with the number of divorced individuals quadrupling between 1970 and 1996. The majority of children in divorced families live with a single parent and often lose contact with the noncustodial parent. A recent review of the literature suggests that many noncustodial fathers fail to keep contact with their children and become delinquent in child support payments because of their dissatisfaction with the custody arrangement. However, there has been little examination of how custody arrangements are typically determined or settled. In addition, divorces that involve spousal violence bring further complications to child custody, visitation, and child support decisions. This study included a 20% random sample of court records for all divorces settled in one county judicial circuit court during 1998. The purpose of this study was to examine characteristics of divorcing adults as well as characteristics of child custody arrangements, visitation, and child support decisions. Contrary to popular belief, findings from this study indicate that divorce actions were almost always settled through agreement of the divorcing parties rather than by adjudication. About 38% of the couples had children in common and between 78 and 92% of cases were settled through agreement, which suggests that fathers are in fact agreeing to the custody arrangement, rather than being forced into it. About one in five records overall noted spousal violence, and there was no significant difference in settlement methods for couples with or without spousal violence. Cases with children and spousal violence were significantly more likely to have also mentioned substance use and postdecree activity. This study suggests a need for more focused attention on divorce cases with spousal violence to reduce postdecree court involvement and safety of children and adult victims, as well as further study into what causes noncustodial parents to lose contact with their children.     

Spherical Photography and Virtual Tours for Presenting Crime Scenes and Forensic Evidence in New Zealand Courtrooms

The delivery of forensic science evidence in a clear and understandable manner is an important aspect of a forensic scientist's role during expert witness delivery in a courtroom trial. This article describes an Integrated Evidence Platform (IEP) system based on spherical photography which allows the audience to view the crime scene via a virtual tour and view the forensic scientist's evidence and results in context. Equipment and software programmes used in the creation of the IEP include a Nikon DSLR camera, a Seitz Roundshot VR Drive, PTGui Pro, and Tourweaver Professional Edition. The IEP enables a clear visualization of the crime scene, with embedded information such as photographs of items of interest, complex forensic evidence, the results of laboratory analyses, and scientific opinion evidence presented in context. The IEP has resulted in significant improvements to the pretrial disclosure of forensic results, enhanced the delivery of evidence in court, and improved the jury's understanding of the spatial relationship between results.     

The awakened instinct: vegetarianism and the women's suffrage movement in Britain

Abstract

This article examines the extent to which vegetarianism was found in the militant and non-militant strands of the women's suffrage movement, and looks at some of the other movements contributing to vegetarian and suffrage thinking. The arguments linking the two movements are discussed, ranging from the psychological identification of women with animals as victims of male brutality, to the empowering idea that women confined to a homemaker's role could still help to create a new and more compassionate world by adopting a vegetarian diet. Vegetarianism and the women's movement are seen as linked with each other, and also with theosophy and socialism, as complementary ways of creating that longed-for new world.
