This article argues that those unjustly displaced from a particular territory T cannot involuntarily lose their rights to reside there, or, as a consequence, their rights of return to it, even if they develop territorially grounded conceptions of the good where they now reside. The contrary position fails to accord the unjustly displaced the respect due to them in virtue of their personal autonomy. Facts commonly alleged to justify the supersession of rights of return to T only provide evidence that the unjustly displaced have abandoned their rights to reside there, or would do so if given a just opportunity to return. The rights of those now residing in T, which author argues may include those responsible for the unjust displacement, may limit the right of return but are unlikely to preclude it altogether. 相似文献

According to William Edmundson, a legitimatepolitical authority is one that claims tocreate in its subjects a general duty ofobedience to the law, and that succeeds increating in its subjects a duty to obey stateofficials when they apply the law in particularcases. His argument that legitimate politicalauthority does not require the state's claim tobe true rests on his analysis of legitimatetheoretical authority, and the assumption thattheoretical and practical authority are thesame in the relevant respects, both of whichare challenged here. In addition, Edmundsonfails to demonstrate that a general,content-independent, duty to obey officials whoadminister the law avoids the criticismsphilosophical anarchists pose to a general,content-independent duty to obey the law. Finally, Edmundson requires a legitimate stateto sincerely claim to create a generalduty to obey the law, yet he also argues thatin some cases the state ought to make literallyfalse claims regarding the particular dutiesincumbent upon its subjects. Issues in current capital cost reimbursement to community hospitals by Medicare and Medicaid are described, and options for change analyzed. Major reforms in the way the federal government pays for capital costs--in particular substitution of other methods of payment for existing depreciation reimbursement--could have significant impact on the structure of the health care system and on government expenditures. While such reforms are likely to engender substantial political opposition, they may be facilitated by broader changes in the reimbursement system. 相似文献

Body image and sexuality, both physically-oriented domains of the self, are likely linked, but few studies have examined their associations. In the present investigation, we studied emerging adult undergraduates (ages 17–19), focusing specifically on risky sexual behaviors and attitudes. Participants (N=434) completed a survey on body image, lifetime sexual behavior, sexual double standard attitudes, and attitudes about condoms. Males who evaluated their appearance more positively and who were more oriented toward their appearance were more likely to report risky sexual behavior, yet females who evaluated their appearance more positively were less likely to report risky sexual behavior. For most sexual attitudes, patterns did not differ by gender. Individuals who were more oriented toward their appearance believed more in the sexual double standard, and those who had more positive evaluations of their appearance perceived fewer barriers to using condoms. Behaviors that pose threats to safety and health, including binge drinking and unprotected sex, increase during a week-long
break from university. Understandings with peers regarding these behaviors may be important for predicting behavior and related
harms. College students (N = 651; 48% men) reported having understandings with their friends regarding alcohol use (59%) and sexual behavior (45%) during
Spring Break. These understandings were to engage in behaviors characterized by risk (e.g., get drunk [23.5%], have sex with
someone new [5.2%]) and protection (e.g., drink without getting drunk [17.8%], use condoms [15.8%]). After controlling for
previous semester behavior and going on a Spring Break trip, Get Drunk Understandings predicted a greater likelihood of binge
drinking and alcohol-related consequences; No/Safe Sex Understandings predicted condom use; and Sex Understandings predicted
not using condoms. Understandings with friends regarding Spring Break behavior may be important proximal predictors of risk
behaviors and represent potential targets for event-specific prevention. 相似文献
