Recent scholarship has given increasing attention to studying women’s involvement in conflict and mass violence. However, there is comparatively less discussion of the experiences of women as actors and perpetrators in conflict, and limited discussion of women as defendants in international criminal tribunals. This article explores this under-researched area. By analysing legal materials from the cases of six female defendants, this article investigates the extent to which legal discourses are shaped by stereotypes regarding femininity, conflict and peace. It identifies three gender narratives—mothers, monsters and wives—used in relation to female defendants, which highlight the incompatibility of femininity with violence, and deny women’s agency in political and military contexts. Thus, this article concludes that female defendants in international criminal tribunals are viewed through gendered lenses, and discussed in accordance with gendered themes. This gendered justice is problematic, as it reinforces patriarchal gender stereotypes, and may hinder attempts to facilitate gender justice. 相似文献

In 1985 Sheila Jeffreys alleged that the rise of sexological discourse concerning female inversion in the early twentieth century obliged women of the interwar period in the UK to reject female affection for fear of being labelled lesbian. Several historians have demonstrated that sexological ideas gained very little general currency before Radclyffe Hall's novel The Well of Loneliness (1928). Research on specific women suggests that such fears were less prevalent than surmised. An influential discourse invoking tropes of emotional femininity, rather than inversion, was embodied in Clemence Dane's Regiment of Women (1917), presenting female same-sex relationships as mired in morbid emotions and parasitic manipulation. It had significant cultural resonance for well over a decade. A counter-discourse argued that emotionally healthy, reciprocal female friendship might form a sustaining element for women unable to marry. This article reflects on the variety of finance sources to African countries, including aid flows, remittances, development finance, private equity and bonds and foreign direct investment. In order to address the poverty challenge, estimated at about $66 billion annually, these finances must be applied appropriately in various economic sectors, in particular the infrastructure sectors. These include both physical assets (transport, energy, water and sanitation and information and communications) and social services (hospitals and clinics, education and low-income housing). Governments are ultimately responsible for ensuring access to infrastructure for their citizens. However, developing-country governments are unable to address the infrastructure backlogs, let alone develop new assets, especially in the least developed countries in Africa. Governments rely on alliances with international partners, development finance institutions and, importantly, the private sector. With a changing geopolitical landscape following the Northern-induced global financial meltdown, stagnation on global governance reform and failure to reach agreement on issues ranging from trade (Doha Development Round) to climate change (United Nations Convention on Climate Change), the India–Brazil–South Africa (IBSA) Dialogue Forum finds itself at the proverbial crossroads. At this point, with no summit having taken place since 2011, the future of IBSA is uncertain in part because the three IBSA partners have allowed ambivalence and lack of leadership to hold sway. Yet the current fluidity in the international environment has ironically meant that IBSA is more relevant and needed than ever before. IBSA is well placed to play a vital role in arresting the current trajectory of the global governance architecture, particularly when it comes to concerns of development. As this article argues, it is in the area of development cooperation that IBSA has found its niche in demonstrating the possibilities that development diplomacy and South–South cooperation avail, while challenging traditional norm conceptions when it comes to the future of international development financial institutions. Yet the question remains as to how this will be used going forward, as there is little strategic discussion between the trilateral partners on the future of development diplomacy and the IBSA Fund. 相似文献

Child abuse allegations in custody and access disputes are serious matters and present family courts worldwide with major problems. This article reports a large research study just completed that investigated the way the Family Court of Australia managed child abuse cases. The study showed that such cases had become a substantial part of the court's current workload, their "core business" in fact. The families involved had many difficulties, including a history of family violence, and the present system was not appropriate for their particular problems.
