The Confidence Game: Of Others and of Bernard Madoff

This is the first in a series of five articles focusing on how Bernard Madoff’s confidence game (con game) worked. This paper first examines three con games in order to isolate their common elements. What went on in Madoff’s offices is generally what goes on in most con games: extensive preparations, elaborate props, pretense, victims convinced that they have much to win and little to lose, greed, and the ability to disorient and fool. Little in Madoff’s world was what it seemed to be.

The power of aspirations and expectations: the connection between educational goals and risk behaviors among African American adolescents

Numerous studies and interventions have been designed to either reduce the prevalence of risky behaviors (substance use, sexual activity, etc.) or increase the level of educational activity for adolescents. Research suggests that these two constructs may be related yet little is known about this relationship among African American youth. Archival data from the Risk Reduction Project was used to explore the connection between the protective factors of educational aspirations/expectations and recent participation in risky behavior. Results suggest that recent use of marijuana, alcohol to the point of intoxication, and sexual activity predicted lower aspirations and expectations among African American youth. From a positive youth development perspective, this study suggests the development of holistic interventions that build educational assets in youth, in addition to working to minimize risk behaviors. Limitations and suggestions for future research are also discussed.     

Tort Law Culture: Image and Reality

This article highlights two contrasting images of tort. The first reflects the traditional portrayal of justice, depicting tort as an independent ‘natural’ system of rules of universal application forming the foundation of a just society. The second is more recent and relates to the perceived development of a damaging compensation culture. Focusing on personal injury litigation, we show how these portrayals differ from the reality of tort. In practice it is heavily influenced by institutional arrangements: the importance of both welfare provision and liability insurance is highlighted, and the effects of a ‘no‐win no‐fee’ claims market are examined. The operation of tort is very much affected by commercial interests and the economic demands of the institutions which surround it. Overall we conclude that the images of tort fail to reflect how the personal injury compensation system actually operates.     

The fallacy of the two-minute acid phosphatase cut off

Research was carried out to determine whether the likelihood of obtaining a positive Acid Phosphatase (AP) test result is affected by the make and type of paper used. Also, we aimed to investigate the frequency of AP positive reactions occurring after 2min using a series of known semen dilutions and to determine whether spermatozoa transfer onto the paper during the act of AP screening. In this research, most brands of paper tested were able to detect a 1 in 40 semen dilution within 2min. Leaving AP test papers for longer will allow the detection of greater dilutions of semen and as the amount of ejaculation is not reliably known in most casework situations and levels of AP activity can vary in different men, this will increase the seminal detection rate in sexual offence allegations.
