善意原则在WTO争端解决中的适用

善意原则不仅是国内法律制度中的一般法律原则,也是国际法律制度中的一般原则.善意原则构成了国际关系交往的基础.联合国宪章和条约法公约都规定了善意守约的原则.国际法院肯定善意原则的地位和作用.世界贸易组织争端解决程序中,善意原则得到了一定程度的适用.善意推定,善意解释条约,善意履行义务,善意行使权利,构成了善意原则的主要内容.但善意原则虽规范世界贸易组织协议,其本身却不能产生独立的义务,也不能替代现有的义务.违约并不等于非善意行事.合理、客观、公正、禁止滥用权利、正当程序等,都在一定程度上体现着善意要求.     

光船租赁合同下船舶所有人的风险问题研究——兼谈《联合国国际货物运输合同公约》的相关规定

光船租赁是船舶运营方式的一种,对于搞活航运,发展国民经济具有重要意义。中国《海商法》第六章关于光船租赁合同下当事人权利和义务的规定均为任意性规范,不具有强制适用效力,只有在光船租赁合同双方当事人未有另外不同约定或者没有约定时才适用,且规定较为原则,难以满足复杂的海事实务需要。笔者针对实务中光船租赁合同下船舶所有人所面临的相关风险从理论上加以分析,并提出了新的观点。

通过对美国联邦第二巡回上诉法院在the＂Jaldhi＂案中判决的评述,分析Rule B下电子汇款转账扣押的发展演变过程及该案判决不再被看做是Rule B下＂财产＂的原因,并就该判决给实践带来的影响提出应对措施。     

CAR在病毒性心肌炎和扩张型心肌病心肌中的表达

目的探讨病毒性心肌炎(viral myocarditis,VMC)和扩张型心肌病(dilated cardiomyopathy,DCM)的发病机制及相互关系,从而提高心源性猝死法医学鉴定的可靠性和准确性。方法对VMC组22例、DCM组20例和对照组16例的心肌组织中柯萨奇-腺病毒受体(coxsackie-adenovirus receptor,CAR)的表达进行改良的免疫组织化学研究。结果 VMC组和DCM组心肌组织细胞膜呈现深棕黄色阳性颗粒,有较高水平的CAR表达,与对照组比较,差异有统计学意义(P<0.05),对照组染色阴性。结论 VMC和DCM组心肌中CAR的高表达,提示VMC和DCM的发病机制可能与病毒感染有关,病毒感染并破坏心肌细胞导致心肌细胞坏死,心功能受损,使VMC进展为DCM。     

Long Han SCM Agreement Says “No” to Charges against RMB Exchange Rate as Export Subsidy

Recently one of the big charges raised mainly by the US against RMB exchange rate is the so-called undervaluation of RMB exchange rate as constituting a subsidy for China’s exports, the US even threatens to refer it to international or domestic settlement. However, the study on the provisions of subsidy, i.e., financial contribution, benefit conferral and specificity, the SCM Agreement indicates that RMB exchange rate neither constitutes financial contribution in art. 1.1 of the SCM Agreement, nor comes in line with the listings of the Illustrative List of the Agreement. The prevailing exchange rate of RMB is the only benchmark for the measurement of the value of RMB except that no other methods are available to be used to properly determine whether RMB exchange rate confers any benefit to exporters. As regards specificity requirement, RMB exchange rate is unspecific, on the contrary, it is among the policy measures for the government to regulate economy.     

Implementation and Validation of the Teleshake Unit for DNA IQ™ Robotic Extraction and Development of a Large Volume DNA IQ™ Method

Abstract: Automated platforms used for forensic casework sample DNA extraction need to be versatile to accommodate a wide variety of sample types, thus protocols frequently need modification. In this study, DNA IQ? methods previously developed for the Biomek^® 2000 Automation Workstation were adapted for the Teleshake Unit using normal volumes and all deepwell extraction, and a large volume DNA IQ? method developed. DNA purification without detectable contamination of adjacent reagent blanks is reported in the extraction of tissue samples containing several micrograms of DNA. Sensitivity and contamination studies demonstrated similar performance with the manual organic extraction method for bloodstain dilution samples. Mock casework samples demonstrated the effectiveness of the Teleshake and Teleshake large volume methods. Because of the performance and increased versatility of the DNA IQ? extraction with these modifications, the Teleshake Unit has been implemented in both normal and large volume automated DNA extractions at the Virginia Department of Forensic Science.

未成年人内隐攻击性特征的群体差异研究

采用IAT范式对中学生和未成年劳教人员的内隐攻击性进行了实验研究,发现未成年个体偏好攻击性词,具有内隐攻击性的倾向;在内隐攻击性倾向下,中学生被试都偏好身体攻击,即内隐攻击性特征独立于性别因素;中学男生与男劳教人员在身体攻击词、言语攻击词方面的差异不具备统计学意义。     

后危机时代的中国经济结构转型——基于经济结构调整的视角

实现经济结构调整和转型不仅是中国长期以来面临的重要课题,更是后危机时代中国建设资源节约型、环境友好型、生态和谐型社会的关键。但随着国际经济危机的陆续蔓延和多年来经济结构累积的深层次问题和矛盾的逐步凸显,中国的经济结构失衡导致了国民经济的总量失衡,因此,应基于消费结构、产业结构、技术创新、外贸出口结构四个视角来进行经济结构的调整与转型。
