The public costs of private blessings: Fundamentals of the economic role of government

The main thrust of this overview is to demonstrate how the shift of government authority over time—from a defense of the realm against foreign intruders to an adjudication of conflicting citizen claims—has created a new set of problems and challenges for the modern state in search of development. It is argued that the power of the state expands as traditional forms of economic rivalries and class claims weaken, and as recourse to legal decision-making becomes widely accepted by all social and economic sectors. Government has proven better able to satisfy existing claims than at initiating new forms of social relations. Experiences in a variety of economic structures thus argue for a continued interplay of public and private, federal and personal claims. Dangerousness of civil commitment candidates

This study followed a large, statewide sample of civil commitment candidates both in and out of the hospital for 6 months following their postcourt hearings to determine their postcourt dangerousness. It objectively measures dangerousness by dividing it into five legal components of behavior: (1) type, (2) object, (3) frequency, (4) weapon/means, and (5) severity of outcome. Using data from ward charts, readmission evaluations, recommitment affidavits, and arrest and community mental health center records, it describes candidates' dangerousness in terms of those, five components and compares that dangerousness with the alleged dangerous behavior that brought them into the civil commitment process. It finds that candidates do not tend to be dangerous in the 6 months following their court hearings.     

Reasons for refraining from criminal activity

In order to establish the relative importance of reasons for not engaging in illegal activities, respondents were administered a questionnaire containing a list of possible factors that could account for not committing crimes, and were then asked to rank them. Multidimensional scaling analyses revealed the underlying structure of these factors. Specifically, respondents tended to structure their reasons based on the formality/informality of a negative consequence and the relative seriousness of a sanction.
