情境预防视阈下首都社区安全治理——基于北京市23个社区的调查分析

情境预防理论表明首都社区安全治理绝不能仅依赖警察为主体的国家强制力,而应通过社区情境的优化来达到无为而治的社区治理效果。基于对北京市23个社区的调查分析,发现社区物理环境显著影响着社区安全度,楼房社区-自住平房-公寓-出租平房形成自高至低的社区安全梯度,因此情境预防应融入社区物理环境的规划-设计-建设-维护流程。另外,社区社会情境同样显著影响着社区安全度,社会治安综合治理机制与社区警务机制作为安全网络的双重支柱,应由压力型体制下单向执行转向双向互动网络,而基于互联网与物联网的社区大数据平台应构成社区神经系统与实时自动监测系统。

美国刑事立法中的自我防卫是根据不同的保护权益而区分的防卫类型之一,为正当防卫的基础形式,自我防卫的成立要件大致包括非法武力的存在、防卫的紧迫性、防卫武力的合理性、行为人对防卫情境的(合理)相信以及相对的躲避义务(少许州)。美国刑事立法中的自我防卫以行为人(合理)相信防卫情境为判断模式,偏重保护防卫人之自治权利,且其规定详实而明确,极好地保障了正当防卫权利司法合理适用,这对于完善我国正当防卫制度颇有启发。     

大数据背景下重大突发事件防控体系建设的路径研究

重大突发事件对公安机关的案件防控是一次严峻的挑战,危机中暴露了诸多短板和不足。对重大突发事件下发生的案件进行深层次的数据分析和研究,提出从源头遏制案件发生是防控的核心,全面掌握重点有效打击犯罪是防控的关键,电信网络诈骗是防控的焦点,高发多发的盗窃案件是防控的重点,由点成线、由线成面、由面成体的防护网是防控的基础,凝心聚力是防控案件的重要保障。通过研究进一步强化公安机关的职能作用,提高应对重大突发事件的能力和水平,有针对性开展案件防控,持续提升打击犯罪的效能,维护社会和谐稳定。
