海峡两岸商业秘密保护与竞业限制实践之比较研究

本文从竞业限制的合理范围、期限、补偿金、违约金、诚信原则等若干方面,对海峡两岸有关商业秘密保护与竞业限制的法律机制、审查标准、司法实践进行了比较研究,希冀为大陆商业秘密保护与竞业限制立法提供参考与借鉴。     

Real-time forensic DNA analysis at a crime scene using a portable microchip analyzer

An integrated lab-on-a-chip system has been developed and successfully utilized for real-time forensic short tandem repeat (STR) analysis. The microdevice comprises a 160-nL polymerase chain reaction reactor with an on-chip heater and a temperature sensor for thermal cycling, microvalves for fluidic manipulation, a co-injector for sizing standard injection, and a 7-cm-long separation channel for capillary electrophoretic analysis. A 9-plex autosomal STR typing system consisting of amelogenin and eight combined DNA index system (CODIS) core STR loci has been constructed and optimized for this real-time human identification study. Reproducible STR profiles of control DNA samples are obtained in 2 h and 30 min with ≤0.8 bp allele typing accuracy. The minimal amount of DNA required for a complete DNA profile is 100 copies. To critically evaluate the capabilities of our portable microsystem as well as its compatibility with crime scene investigation processes, real-time STR analyses were carried out at a mock crime scene prepared by the Palm Beach County Sheriff's Office (PBSO). Blood stain sample collection, DNA extraction, and STR analyses on the portable microsystem were conducted in the field, and a successful “mock” CODIS hit was generated on the suspect's sample within 6 h. This demonstration of on-site STR analysis establishes the feasibility of real-time DNA typing to identify the contributor of probative biological evidence at a crime scene and for real-time human identification.

In the absence of research on religion and the Internet in Africa, this paper examines select African Pentecostal ministries that are developing websites as a major new interface for interacting with their membership, with potential converts, competing or partnering religious groups, and organs of the media and the state. It argues that this new media platform constitutes an important site for the constitution of Pentecostal leadership in the contemporary African and diasporic contexts.

Forensic DNA evidence and the death penalty in the Philippines

The death penalty remains a contentious issue even though it has been abolished in countries such as Australia, New Zealand, Canada, European Union member nations and some Asian countries such as Cambodia, East Timor and Nepal. Many argue that the irrevocability of the death penalty, in the face of potential erroneous convictions, can never justify its imposition. The Philippines, the first Asian country that abolished the death penalty in 1987, held the record for the most number of mandatory death offenses (30 offenses) and death eligible offenses (22 offenses) after it was re-imposed in 1994. Majority of death penalty convictions were decided based on testimonial evidence. While such cases undergo automatic review by the Supreme Court, the appellate process in the Philippines is not structured to accept post-conviction evidence, including DNA evidence.Because of the compelling nature of post-conviction DNA evidence in overturning death penalty convictions in the United States, different groups advocated its use in the Philippines. In one such case, People v Reynaldo de Villa, the defendant was charged with raping his 13-year-old niece that supposedly led to birth of a female child, a situation commonly known as ‘criminal paternity’. This paper reports the results of the first post-conviction DNA test using 16 Short Tandem Repeat (STR) DNA markers in a criminal paternity case (People v Reynaldo de Villa) and discusses the implications of these results in the Philippine criminal justice system.     

A method for the rapid detection of the zopiclone degradation product 2-amino-5-chloropyridine

Zopiclone (Zimovane) is a cyclopyrrolone compound which exhibits hypnotic and sedative effects while also exhibiting anticonvulsant and muscle relaxant activities. The detection and quantification of zopiclone is difficult. It has a high molecular weight compared to most other commonly used drugs, therapeutic levels are not high, and it is unstable in nucleophilic solvents. A degradation product of zopiclone, 2-amino-5-chloropyridine (ACP) together with a method for its detection using high-performance liquid chromatography with diode array detection has been described previously. An account is presented of a simple method for the detection of ACP using gas chromatography with mass selective detection (GC/MS) which will facilitate detection of zopiclone use as part of a routine screen.
