The aim of this article is to explain the speed with which Member States transpose EC directives in the maritime sector. By discussing earlier work, the focus is on explanatory factors related to the contents of the directive that needs to be transposed and the context within which national transposition takes place. The authors' expectations have been tested using data across seven Member States and 32 maritime directives. Using survival analysis based on Cox regression, several political‐administrative and legal factors are identified that have an impact on the speed of transposition. The political sensitivity of the directive and the total number of national implementing measures lengthens the duration of transposition, while the degree of specialisation of the directive, the use of package law and experience speed up transposition. The authors also find that the impact of some of these explanatory factors changes over time. This underscores the importance of taking time seriously and to explore time dependency in further theoretical work on explaining policy‐making processes. 相似文献

Scholars estimating policy positions from political texts typically code words or sentences and then build left‐right policy scales based on the relative frequencies of text units coded into different categories. Here we reexamine such scales and propose a theoretically and linguistically superior alternative based on the logarithm of odds‐ratios. We contrast this scale with the current approach of the Comparative Manifesto Project (CMP), showing that our proposed logit scale avoids widely acknowledged flaws in previous approaches. We validate the new scale using independent expert surveys. Using existing CMP data, we show how to estimate more distinct policy dimensions, for more years, than has been possible before, and make this dataset publicly available. This study demonstrates that computational modeling and, in particular, agent‐based modeling (ABM) offers a viable compatriot to traditional experimental methodologies for criminology scholars. ABM can be used as a means to operationalize and test hypothetical mechanisms that offer a potential explanation for commonly observed criminological phenomena. This study tests whether the hypothesized mechanisms of environmental criminology are sufficient to produce several commonly observed characteristics of crime. We present an ABM of residential burglary, simulating a world inhabited by potential targets and offenders who behave according to the theoretical propositions of environmental criminology. A series of simulated experiments examining the impact of these mechanisms on patterns of offending are performed. The outputs of these simulations then are compared with several well‐established findings derived from empirical studies of residential burglary, including the spatial concentration of crime, repeat victimization, and the journey to crime curve. The results from this research demonstrate that the propositions of the routine activity approach, rational choice perspective, and crime pattern theory provide a viable generative explanation for several independent characteristics of crime. 相似文献

This article traces the disconnect in the constitutional study of the European Union from the Maastricht era to the euro crisis. In the Maastricht era, a discourse of ‘post-sovereignty’ came to dominate theoretical enquiry, reflecting but also distorting a number of material developments: the ‘end of history’, the retreat of critical theory into discourse analysis and systems theory, and the prioritization of law over politics. Jürgen Habermas was a key intellectual figure in driving this ideological mix at the very moment when anti-systemic challenges began to return, both formally and informally, as exemplified in the German Constitutional Court and the French political scene. In revisiting the idea of political constitutionalism, we can foreground this constitutional disconnect and show how it contributes to the irresolution of the subsequent euro crisis conjuncture. 相似文献
